Mumbai, Nov 11: Modi Group Company (KK Modi Investment and Financial Services Pvt Ltd) has obtained an ad interim injunction against ATN International Ltd (Asia Television Network Ltd) and its managing director Siddhartha Srivastava restraining them from using the logo `ATN' in connection with their ATN Bangla channel."A prima facie case has been made out in the petition for an order of injunction restraining the said respondents from utilising the said trade mark and/or copy right and/or logo ATN Bangla in any manner whatsoever," the Calcutta high court said in its order on November 8, 2000.
ATN had a strategic alliance with KK Modi and Investment Services Pvt Ltd (Modi) whereby Modi had paid ATN Rs 5 crore. According to the agreement, the parties had agreed to conduct a due diligence on ATN, failing which ATN was to refund the said amount to Modi.
According to Modi, ATN did not complete the due diligence whereby Modi had to terminate the strategic alliance with ATN.
Modi has also alleged that ATN issued post-dated cheques to Modi which bounced, thereby defrauding Modi of crores of rupees.
Thereafter, Modi took resort to legal proceedings and obtained a decree against ATN and Mr Srivastava and also attached their trademark and copyright and the said logo `ATN.'
ATN, in the meanwhile, entered into a strategic alliance with a Calcutta company Arihant Credit Capital Ltd. The name of Arihant was later changed to ATN International Ltd. The said ATN International Ltd is now using the ATN mark and logo for its satellite channels - ATN Bangla and ATN World.
Modi has already filed contempt proceedings in the Bombay High Court against ATN, Mr Srivastava and ATN International Ltd.
Modi had filed a suit in Calcutta high court restraining ATN International from using the trademark `ATN' by operating the satellite channel ATN Bangla.
