HC order prevents SMC conflagration

SURAT, June 21: The Fakirbhai Chauhan-S Jagadeesan cold war has been saved from taking on incendiary shape -- at least for the moment -- by a High Court order. It all began when the former mayor with a public grudge against the municipal commissioner challenged the Surat Municipal Corporation to pull down part of Minar Masjid, located at Bhagal Char Rasta, as it was impeding road alignment. Two months ago the High Court had given the SMC the go-ahead to demolish part of the minar provided they did not touch the place of worship. The court had given six weeks to the aggrieved party -- Bhagal Minar Trust -- to move the Supreme Court.pWith six weeks having lapsed, the former mayor apparently grabbed the minar issue as an opportunity to embarrass Jagadeesan. The commissioner, however, had his defence ready: a High Court order extending the appeal time by another two weeks.When asked whether he would pull down the part of the minar, Jagadeesan said if the court order was to be implemented strictly, about six religious structures would have to be demolished. Incidentally, about two years ago, then Municipal Commissioner S R Rao's move to demolish the minar had been resisted by the minority community, and the Minar Trust had obtained a stay from the High Court seeking a stay. The High Court directed the SMC not to demolish the Minar. It now remains to be seen what Jagadeesan will do should the Trust fail to acquire a stay order by July 3. In case, the Supreme Court uphold the High Court order, it will be difficult for the commissioner to withstand the pressure from the elected wing to bulldoze the part of the minar.
