Two officers' remanded to judicial custody

CHANDIGARH, June 21: Executive Engineer (Roads) Harsh Kumar and Sub-Divisional Officer Gurpreet Singh were remanded to judicial custody till July 1 by UT Judicial Magistrate (Ist Class) A.K. Bishnoi in the engineering department kickback case, here today.

The two had surrendered before the UT Vigilance Cell on June 19 after being booked under the Prevention of Corruption Act along with Section 406, 409, 420 and 120-B of the Indian Penal Code.A case had earlier been registered against former UT Chief Engineer K.K. Jerath "and others" on the basis of certain diaries recovered from the residences of the alleged middlemen during raids by the Income Tax authorities in November last year.

According to the prosecution, approximately Rs 32,200 were received by Harsh Kumar as illegal gratification. While "middlemen" Sunil Kalia's diary had mentioned Rs 14,800 against his name, another Rs 17,400 were paid to him for procuring supply orders in favour of certain firms, while he was in the Municipal Corporation. Gurpreet Singh had received Rs 27,050 as kickbacks, the prosecution had added. Meanwhile today, seeking his police remand for three days, the Assistant District Attorney stated that Rs 11,900 were entered against his name in Sharma brothers' diaries, while Rs 15,150 were scrawled against his name in Kalia's diary.The accused was also required as a diary maintained by him regarding the supply orders placed and kickbacks received, along with name of several firms, were to be recovered from his possession, the ADA further stated.

Opposing the plea, the defence counsel contended that further police remand for the accused would not be justified as he had been thoroughly interrogated and no recovery was to be made. The prosecution was merely cooking up tales to needlessly harass him, he stated.The case against Gurpreet Singh was weak and another accused, R.P. Vashistha, had been released on bail by the Sessions Court following the prosecution's failure to submit the challan within the prescribed period of 90 days. Further, the diaries were inadmissible as evidence in light of the recent Supreme Court judgment in the L.K. Advani case, he concluded.
