Bail plea: Notice for today

CHANDIGARH, Aug 21: Following the "expiry" of the "prescribed period for submitting challan" in the alleged jailbreak conspiracy case, accused Satnam Singh and Baljit Singh today moved an application for release on bail.

Another application for arresting alleged assassins of former Punjab chief minister Beant Singh, Jagtar Singh Hawara and Jagtar Singh Tara, in the same case was also moved by the Chandigarh Police.

Taking up the application for Satnam Singh and Baljit Singh's release on bail, UT Judicial Magistrate (Ist Class) A K Bishnoi issued notice to the State for tomorrow.

The other application for Hawara and Tara's arrest will also come up for consideration before UT District and Sessions Judge B S Bedi tomorrow.

In the bail plea, the defence counsel stated that the duo were entitled to be released as the police had failed to submit the challan within 60 days from the date of arrest.

He added that the "prescribed period" in the jailbreak case was sixty days as the duo were booked under offences punishable by not more than ten years.

It was added that no useful purpose would be served by keeping them in custody and, if released on bail, they would not abuse the conditions.

Booked under the Explosive Substances Act along with Section 419, 425-B, 420, 468 and 120-B of the Indian Penal Code, the duo had allegedly conspired to smuggle the explosive into the jail complex. While Satnam Singh was arrested on June 11, Baljit Singh was apprehended the next day.

According to the prosecution, Baljit Singh, a contact between Hawara and other accomplices, had handed over about 1.45 lakh to Satman Singh for purchasing explosive from a contact at Ropar. The wireless sets, recovered along with PETN explosive upon Satnam Singh's disclosure statement, were also to be smuggled into the jail through him, it had been added.

Meanwhile, in the other application, the police stated that sufficient evidence to arrest the duo had been gathered from their interrogation.

The Sessions Judge had earlier permitted the police to examine the accused within the jail premises in the superintendent's presence.

They had alleged that Hawara and Tara, along with Satnam Singh and other accused, had hatched the conspiracy.The burfi made up of RDX, handed over to the duo in the jail, was obtained by alleged co-conspirator Balwinder Singh from a "militant", Didar Singh alias Bunty, in Amritsar on Hawara's instructions, they had stated.Co-accused Jaswant was also sent by Hawara to city lawyer D.S. Rajput for getting two mobile phones, which were smuggled into the jail premises in September 1997 and February 1998.
