Law and Justice Minister H R Bhardwaj provided the information in a written reply in Rajya Sabha on Monday quoting the figures as on March 31, 2007, gathered by a department-related Parliamentary Standing Committee.
Further, the CBI has reported that it is investigating around 65 such cases.
The Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice while studying the issue of 'Electoral Reforms' was seized of the matter pertaining to chargesheet files against sitting MPs/MLAs in different competent courts of law.
All state governments and UT Administrations were asked to provide the requisite information to the committee.
Some states/UTs have furnished the information, as per which around 1,300 cases are pending against sitting MPs/MLAs in various courts, the Minister said.



How can criminals or accused be allowed to even stand for elections? If there are approximately 550 members in the Parliament which means there is an average of 2.36 alleged cases pending against each MP according to this report.The election should make all candidates, with any cases pending against him or her, ineligible to stand for elections for any sort of post. Then and only then will India start to shine. Any political party that opposes the passing of such a law should be ostracised and banned. Hopefully that will start a snowball effect and weed out the Babus and Judges with the same 'pending cases'
It is an alarming revealation that as many as 1300 cases are pending against our Hon'ble law makers. If the law makers themselves turn into law breakers who will protect the common man against the depredations of criminals? Again, the pendency of 1300 criminal cases works out to an average of 2 cases against each law maker. Presuming that 50% are clean, it is clear that the remaining 5o% have more than 4 cases pending against each. Add to these cases that are not registered against the honourable law makers because of their intimidating station in the political domain. All this presents a worrisome scenario. Sooner than later, the people will lose confidence in them and that may be the beginning of the end of democracy. Those law makers who have the interest of the people at heart must step out and come up with an action plan to rid the Parliament of those found involved in criminal cases. Incidentally it may be instructive to know the extent of rot in the civil services and the judiciary, the other two pillars of the democracy.
Our judicial procedure is so desgned as to protect the murderers, rapists, and fraudsters and to harass the innocent. No sensible man goes to the courts to secure justice. Either he suffers in silence or seeks the help of goondas to seek justice. The enire judical system needs to be revamped urgently but we cannot expect any such action from the Parliament as the Parliament itself has become a safe haven for the antisocial elements the society.Only Talibani jurisprudence will create some fear in the minds of the criminals who are sitting in the parlliament.
It would be interesting to know the number of cases pending against the IAS officers, derisively called by the media as 'Babus', judges of the Supeme Court and High Courts. That would reveal the quality of governance delivered by the Government and the extent to which it is degraded by each institution. An institution is as good as the people staffing it. Let the Law Minister also disclose the figures of pending cases accoring to political parties, Central services and States.
Its a very good initiative taken by the Law and Justice Minister H. R Bharadwaj. Hope that this initiative brings some fruitful results and the culprits be seen behind the bar. Then only it can be thought that the CBI and the Law and Justice Ministry is bringing justice visible so that others may think in future to do the wrongs again.
Pathetic state of affairs, judiciary please finish these cases early and put the guilty behind bars as soon as possible.
