New Delhi, March 26: The Supreme Court set a 10-day deadline for the Gujarat government to constitute a special investigation team (SIT) to ‘inquire and investigate’ into 14 cases related to the 2002 communal riots, including the Godhra train carnage.

The 14 cases include the one in which Mohd Rafudan Ansari and another person are named in FIR No 09/2002 as the accused who torched the Sabarmati Express at Godhra.

The SIT ‘shall inquire, investigate/further investigation into these cases’, a Bench headed by Justice Arjit Pasayat said while directing it to submit its report in a sealed cover within three months.

The court's directives follow a bunch of petitions filed by the NHRC, individuals and NGOs which had sought transfer of the trial of the riots' cases outside Gujarat and further investigation or re-investigation by the CBI.

The petitions were filed after several witnesses turned hostile amidst allegations of threat, coercion and inducement to derail the investigation.

The SIT would be free to evolve its own modalities for the purpose of carrying out investigations into the cases, the apex court said.

The team would comprise ex-CBI chief R K Raghavan and former DG of UP Police C D Satpathy besides three IPS officers from Gujarat -- Geeta Johri, Shivanand Jha and Ashish Bhatia.

While Raghavan would be the Chairman of the SIT, Johri would be the Convener of the team.

SC's Verdict On Guj's Probe by Ashok Mehdiratta on 27 Mar 2008

SC's criticism is a clear indicator of our resistance to see any logic because of our tendency to measure every thing with religious color.SC is clear in what it decides. When court pulled up CBI for giving clean chit to Tytler wehailed our judiciary, when CBI cleared Italian Gentleman in Bofor's case SC turned the heat on UPA and CBI,we hail it as historical verdict, but when it comes to Gujarat SC is termed as UPA'sagent. We need to put a stop to all these. It was surprising to see that one of our esteemed readers who happens to an old judge has criticized this verdict. Please leave SC out of uncalled for comments.

6 LONG YEARS, 10 ENQUIRY COMMISSIONS, ONE DEAD JUDGE AND WE ARE STILL PROBING by ASATYAMEV JAYATE on 27 Mar 2008

One of the boasts of the Gujarat CM Narendra Modi and an astonishingly large number of his defenders in the BJP hierarchy in New Delhi used to be that he had ‘controlled’ the orgy of violence, arson and loot within 72 hours flat. Such a feat, the spin-doctors had started crowing, had never before been accomplished in the state that has been prone to a vicious spiral of communal killings since 1969. Nothing could have been farther from the truth. More than a month later, Gujarat continued to not just smoulder but also burn in places. Brutal killing of one another by the two communities persisted. Selective burning down of homes and businesses seemed to have become an unending pastime. The conflagration had continued to erupt in not only several sensitive localities of Ahmedabad but also in distant districts of Anand and Mehsana. As in the initial stages of the slaughter, openly justified by the state government because of the Godhra incident, the police are still looking the other way.

justice for all, not only for one group of people by justice choudhry on 27 Mar 2008
