1997 Delhi blast: SC divided on death for convicted Pak national

New Delhi A division bench of the Supreme Court today passed a split verdict on the plea of a Pakistani national challenging his conviction and death sentence awarded to him in the 1997 Delhi blast case.

While Justice H L Dattu was of the opinion that a fresh trial should be conducted in view that witnesses were not cross-examined by the accused, the other judge, Justice C K Prasad, did not hold the same view.

In view of the split verdict, the matter has now been referred to the Chief Justice.

Mohammad Hussain was convicted and sentenced to death in November 2004 by the trial court for his role in the 1997 Delhi blast which occurred in a blueline bus leaving four people dead and 24 injured.

The trial court had termed the case as “rarest of rare” and had awarded death sentence to Hussain, a native of Jindrakhar village at Okara in Pakistan.

The High Court had in August 2006 upheld the death sentence which was challenged by Hussain before the apex court.

On December 30, 1997, a bomb exploded at Rampura near Punjabi Bagh in West Delhi in a blueline bus. The blast left 28 injured of which four succumbed to injuries later in a hospital.

Hussain was arrested by the police on March 21, 1998. A city court had, however, discharged the other accused in the case -- Abdul Rehman, Azhar Ahmed and Maqsood Ahmed -- for want of evidence.

In 1997, the city was rocked by 22 serial blasts.

Another man accused of causing the two blasts at Karol Bagh, Mohammed Amir Khan was earlier sentenced to 10 years' rigorous imprisonment for one case and life imprisonment for the other by another city court.

how come they are divided over judgement ? i think the judiciary is biased ? publish the names of judges n it will be obvious and how the hell are other asher ahmed n others acquitted due ot lack of evidence ? this will create more injustice n rise to right wing terrorism in response to the islamis terrorism ...time to hand the traitors within the nation and eliminate those operating out n in the country or else commom man wil be forced to take up arms n come to street!

The case of Hussain main accused in Delhi Bus blast in 1997, had been taken 25 years to reach a final verdict of death sentence that too with a divided decision, yet to finalize is unbelievable task of an independent judiciary of India. Such delay should not be entertained and regretted. What about the other 22 blasts which were quaked Delhi in 1977.All accused are deserved stringed punishment of execution except those not caused to killing.

Clearly judges are not worried about time. The blasts have taken place 14 years ago and we still want to discuss the technicalities. What if one of the close relatives of judge is killed in one of such blasts? Will that be a reason enough for them to take quick decisions?

There is no reason to be divided on a matter that concerns the lives of people of this country. Capital punishment is very well justified for the enemies of the country, either from outside or within.
