The decision came last week following which the boy has been released on bail.

According to advocate Shailesh Singh, the youth from the Gomtipur area had procured a fake marksheet of Class X after he failed in the board examination in 2000. The boy, however, went on to pass the examinations till first-year B Com.

In November 2008, he had applied for domicile certificate before the police commissioner, and during the police verification of his documents, it was found that the SSC marksheet was fake.

The police had registered an FIR and the accused was sent to judicial custody after some days of police remand. Meanwhile, the youth applied for bail before the Sessions Court.

Singh said, “The Sessions Court, though, asked the youth to first get it decided whether he has to be prosecuted under juvenile law. And for that we needed to get the permission of the Juvenile Justice Board, which has ruled that since the boy was minor when the offence was committed, he will be considered a juvenile.”
