2G: Court rejects plea to prosecute PC

In a relief for the Union Home Minister P Chidambaram, a Delhi court today dismissed Janata Party President Subramanian Swamy's plea to prosecute him in the 2G case.

Speaking to media after the judgement, Swamy said: "I'm surprised at the order. I will take the matter to high court."

Court had earlier deferred till 12.30 pm the pronouncement of its order on Swamy's plea to prosecute Home Minister P Chidambaram.

At 10 am Special CBI Judge allowed only Swamy to enter inside the court room and conveyed to him asked him to come before 12.30 pm.

"I have been asked to be present in the court before 12.30 pm. I can say that I am confident that the judgement will be delivered today," Swamy told reporters coming out of the court.

Court staff also said that the judge may deliver the verdict around 12.30 pm.

Swamy had moved the court seeking to make Chidambaram as co-accused in the 2G spectrum scam alleging he was as culpable as former Telecom minister A Raja in determining the prices of scarce spectrum and in allowing the dilution of shares.

The Supreme Court on Thursday, while cancelling 122 licences granted by jailed Telecom minister A Raja had said the trial court was perfectly competent to decide the appeal against the Home Minister. It refused to direct the Central Bureau of Investigation to investigate Chidambaram, though delivering a body blow to the government\'s telecom policy.

A Bench of Justices G S Singhvi and A K Ganguly also asked the lower court not to get influenced by its decision to cancel the licences, which it said were granted in an \'\'arbitrary and unconstitutional\'\' manner.

The apex court, which came down heavily on Raja, however, did not find any fault on the part of the Prime Minister and then finance minister P Chidambaram.

Swamy has alleged Chidambaram was as culpable as A Raja since he also had a role in deciding spectrum pricing and allowing telecom companies to offload shares to foreign firms.

The court, on February 1, also halted for two days the ongoing day-to-day trial in the case for writing the much-awaited order on Swamy\'s plea against Chidambaram.

Swamy, who concluded arguments in the trial court in support of his plea, had said the evidence brought on record prima facie established that Chidambaram was also culpable like Raja in the case.

The evidence brought before the court was sufficient to show that Chidambaram, as then finance minister, has prima facie committed offences under the Prevention of Corruption Act and other criminal laws, he said.
