Metropolitan Magistrate Nirja Bhatia asked Trilokpuri resident Jiban Singh to visit the cancer hospital once a week for six months. Singh was found guilty of offences punishable under section 354 (assaulting a woman with intent to outrage her modesty) and 506 (criminal intimidation). Singh was also fined Rs 2,000 by the magistrate.
The case was lodged on the complaint of a woman who alleged that on July 28, 2005 Singh made the audacious attempt to outrage the modesty of her seven-year-old daughter.
However, when the matter was brought before the court, the mother softened down and requested the court to show mercy to Singh. The court, however, did not accede to the plea for total reprieve for the accused, after noting that it was evident from the circumstances and the evidences of the case that the incident had indeed taken place. Counsel for Singh, Anurag Saxena said that the accused, a rickshaw puller by occupation, did not have any criminal antecedents. He said that the offences for which Singh was booked were compoundable and a compromise could have been reached.
