California-based Jasbir Singh, a witness who was earlier declared non-traceable by the CBI, filed the petition through his son seeking quashing of a notice issued by the investigating agency asking him to come to the country and give his statement in the matter.
The CBI, following a trial court order directing it to re-investigate Tytler's role in the case, had issued notice to Singh on January 2 under Section 160 of the CrPC, which empowers the probe agency to seek presence of a witness.
Challenging the summons, Singh said the CBI, allegedly with the aim to help the accused, was insisting on his presence in India for recording of statement.
"If the CBI is really serious and interested in investigating the case and recording the statement of the witness petitioner, then it should have moved under Section 166A (1)(which allows non-resident Indian to testify in foreign courts on the request of probe agency) and not under Section 160 of the CrPC," the petition alleged.
Singh submitted that till the decision on his petition, the proceedings in the trial court be stayed and the CBI be restrained from closing the probe in the case.
The petition, filed by his counsel Navkiran Singh and Sharat Kapoor, is likely to come up for hearing on January 14.
Singh, in an affidavit before Nanavati Commission which inquired into the anti-Sikh riots, had stated that on November 3, 1984 he had overheard Tytler rebuking his men for nominal killing of Sikhs in his constituency.



Why PM (himself a Sikh) and UPA can't order the CBI to go to USA and record the statement of Jasbir Singh who is a witness alleged to had seen to Tytler's inciting killings of sikhs. It is not a question of a few killings but slaughtering of thousands of innocent Sikhs. Why government is hesitant, just to protect some of Congress party's big wigs? What a shame, even after 23 years innocent people can't get justice.Does the Congress led government and UPA chairperson feels happy about the delay and with what face they call Congress party as believers in the ideology of Mahatma Gandhi. Had Gandhi ji been alive, he would not have lived another day after seeing what happened in 1984. It is easy to say 'Sorry"

AND, to think that a Sikh is supporting Sonia and Congress-sponsored genocide of innocent Sikh people, just because he has been given the PM post..... it is sickening...
I don't know what this poor man can achieve, against the powerful criminals in Congress, when Sonia is supporting the people doing genocide of Sikhs in Delhi. Manmohan, even though he is also a Sikh, is supporting Tytler and other Congress people who killed innocent and patriotic Sikhs for no fault of theirs, just for the biscuits thrown to him by Sonia. When CBI is working overtime to bury justice, with the full support of Congress, what can this little man do? The court can only ask CBI to re-investigate, but how can it really make CBI to do a sincere job? CBI can always mess up the case (Like the other bribe-criminal-anti-national episode of the same Sonia/Congress in the infamous Quatrocchi scandal, where the Congress PM and Sonia were instrumental in making way for him to get out of the country, and asking a minister to go to UK to release the bribe money to Quatrocchi and all that non-sense). Nothing good will happen in India, till the anti-national and criminai gang Congress is removed from power by the common people..
