Advocate’s claim rejected, forum says story ‘concocted’

Chandigarh, August 29 The District Consumer Forum, on Friday, rejected a frivolous complaint of an advocate against a computer company who had moved the forum to get false claims.

The complainant had installed an Intex Gold computer for Rs 29,800 and paid Rs 10,000 as advance, on the assurance that he could run his camcorder/video camera and copy or convert the mini cassette of the camcorder on the CD/DVD through the computer.

He alleged that the camcorder could not be copied to the DVD as assured, and the company failed to rectify it. He, therefore, moved the forum against Niva Infotech and Intex Technologies.

Niva Infotech, in its reply, stated that it never assured that the computer was compatible with the camcorder or video camera at the time of purchase.0

The company also said that the complainant did not have a camcorder/video camera and, therefore, the said capability of the camcorder/video camera could not be tested. It was also pleaded that on the request of the complainant, they approached Sony India who satisfied the complainant. But, due to the negligent and careless operation by the complainant, the computer developed defects.

Bansal had approached the police with his complaint but was rejected there, following which he moved the consumer forum, which also did not find any merit in the case. The forum found that there was no fact mentioned at the time of purchase that the complainant could run his camcorder or copy a mini cassette on the CD/DVD through the computer. The forum also found that the complainant was unable to produce the receipt or the camcorder before the forum to suggest if he has/had any such camcorder.

“It appears this is a false ground concocted by the complainant just to harass the company and get back the amount paid by him,” said Jagroop Singh Mahal, President, District Consumer Forum.
