Air Deccan told to pay Rs 60,000 to passenger

New Delhi, October 01 A DELHI court today ordered a budget airline company to pay Rs 60,000 as compensation to a passenger for “misleading representation” of a package ticket scheme.

M L Sudheen, a resident of Mayur Vihar, had bought Air Deccan’s “Super Flier” package of 30 tickets from its website in February 2006 at Rs 50,000. The tickets were valid for a twelve-month period.

When Sudheen requested airline authorities to allow him use the coupons on Delhi-Bangalore and Mumbai-Bangalore routes, the airline stated the package was not applicable to the sector.

Delhi State Consumer Commission Chairman J D Kapoor, while ordering refund of the Rs 50,000—cost of the ticket—and Rs 10,000 as compensation, said, “Even if we assume he had under the wrong impression paid the amount, he could not have forfeited the amount as the airlines did not provide him the service, nor did he avail it.”

The airline had told court that it had displayed “to view current sectors” available at the time of booking on its website. To this, the court said the sectors were in abbreviated form and not prominently displayed.
