Andhra HC quashes quota for Muslim community

Hyderabad A Constitution bench of the Andhra Pradesh High Court on Monday set aside an act legislated by the state Assembly and a subsequent 2007 government order providing 4 per cent reservation to 15 groups belonging to the Muslim community.

The order was passed by the seven-judge bench headed by Chief Justice Anil Ramesh Dave on a petition filed by an advocate K Kondala Rao.

The state government had moved a bill in the Assembly on the basis of a report submitted to it by the Andhra Pradesh Commission for Backward Classes. The bill was later passed by the Assembly.

The report had recommended that the socially and educationally backward should be adequately represented in the state.

The government order (GO) was issued on July 7, 2007 providing the 4 per cent reservation to the 15 groups.

Soon after the High Court order, Chief Minister K Rosaiah directed the state advocate general D S R Murthy to file a special leave petition in the Supreme Court challenging the verdict striking down the government order on the reservation to Muslims in educational institutions and jobs.

"The state government is committed to providing 4 per cent reservation to backward class Muslims in the state," he said in a statement.

Telangana Rashtra Samiti (TRS) chief K. Chandrasekhar Rao had also promised political reservation and a quota in education and employment based on population for Muslims in separate Telangana. Rao had earlier said that Muslims would not be assured of social justice unless they get reservation. He had assured the Muslim community that a special provision in Constitution would be invoked, as was done by Tamil Nadu government, to extend reservation to Muslims in education and employment.

TRS chief had promised that Muslims would get the reservations proportionate to their population, which was 13 per cent to 15 per cent in Telangana. The TRS chief also assured a budget for welfare of Muslims based on their population. He had appealed to the members of the Muslim community to shed self-defeatism and assert themselves in separate Telangana.

The politicians of all hues barring BJP are announcing reservations for minorities just before the elections to capture minority votes.Any elction promise should confirm to the constitutional provisions.It would be still better if the election manifestos are prepared 1 year before the elections are due and sent for scrutiny to CEC and register them.The parties should propogate only those items from the approved manifesto and if they propogate any item not mentioned in the manifesto that party should be banned from contesting election.for two elections.

This is a great slap not only to AP Govt headed by late YSR, but also to MMS,Congress as well as its puppies Retd.(in)justice SACHAR and RANGNATH,who gave the reports only as Congress needs.THIS GOVT IS ACTING AS IF IT HAS COME TO TAKE REVENGE FOR BEING KEPT OUT OF POWER FOR A DECADE.Since the motive is malice, such kicks are bound to occur.It is in the interest of Congress to adopt policy of carrying out inclusive projects instead of communal with an intention of depriving only majority community,even though it is foolish and divided.It is nothing but fooling the public to take steps which would be struck down in the court of law.

We can even think of providing Quotas for musli, christo's minorities etc...since they vote for the politicians of their community. let there be quota on the buses, trains, roads,parks, cinema theaters, jobs, every where. And in this process we can ensure we go back to pre-independance days when the people were discriminated. Our political leaders have no far sight. There is not meaning of merit in our country. Hats off to HC.Quotas have to go for ever as they have not benefitted eithor minority or any other lower castes. ST/SC/OBC and minority have been treated as votes banks in the garb of Quota for 60 years. Therefore in view of the ground reality, let there be economic benefits for all below poverty lines rather than creating Quotas with an eye on votes. Such a shame has to be wiped out and courts are the only hope of the majority of people in India.

Well said.. quotas only take the country backward and have been systemically abused by vote-bank politics of all parties. Addressing all BPL families, irrespective of caste/religion/sex is the only way concession to make. For all the rest only meritocracy must rule if India has to realise its great potential.
