According to information supplied by the MC in response to a Right to Information application filed by Advocate H C Arora, retired employees occupy positions of Superintendent, Junior Engineer, Assistant, Enforcement Inspector among others.
The Corporation's letter reads, "The staff is being appointed on a contract basis in the Municipal Corporation, Chandigarh by inviting applications for the same by giving advertisement in newspapers wherein the eligibility criteria are also prescribed".
However, the MC gave a vague reply to the query whether any advertisements were issued for the appointment of the 63 employees. It said that, earlier, some staff was directly appointed, but at present, all the appointments were being made thorugh proper advertisement in newspapers. The corporation, however, did not mention the date when it started issuing advertisements for the posts.
"Appointments, which are made without advertising vacancies in newspapers, are illegal. In a similar case of Nagendra Chandra, the apex court had on November 28, 2007 terminated the appointments of employees which were made by notifying the vacancies only on a notice board.
Apart from the fact that such appointments are illegal, there are also social aspects of the matter given that a large number of people are on the road searching for jobs," said Arora.
