Appointment of judge: SLP to be filed in apex court

Allahabad, September 25 The Allahabad High Court has decided to move a Special Leave Petition (SLP) in the Supreme Court, challenging an order of a Division Bench of the Allahabd HC regarding the appointment of Justice Dr Satish Chandra as a judge of the High Court.

Appearing on behalf of the High Court, Advocate S P Gupta informed a Division Bench comprising Justice Shushil Harkauli and Justice Vikram Nath on Thursday that the court will file an SLP against the September 17 order of the Bench. It had directed the High Court to produce the documents pertaining to the recommendation of Justice Chandra’s as a judge of the High Court by a committee of three judges.

“There is no need to produce the documents in the court, nor it is required to adjudicate any issue related with the case,” Gupta told The Indian Express.

The case will come up for hearing on October 22.

M C Gupta, a practicing lawyer of the High Court, had urged the High Court to issue a writ of quo warranto, directing Justice Satish Chandra to justify the constitutionality of his appointment as a High Court judge.

The petitioner had also requested the Chief Justice of the Allahabad High Court to stop the allotment of judicial work to Justice Chandra during the time the writ petition is pending.

Gupta’s contention is that Justice Satish Chandra was ineligible for appointment as a High Court judge.
