BJP petitions CEC for removal of Navin Chawla

New Delhi, January 30: Stepping up its campaign against Election Commissioner Navin Chawla, BJP on Wednesday sought his removal on grounds that he "lacks fairness and non-partisan approach" because of his "close proximity" to the Congress and its leadership.

A five-member delegation headed by BJP General Secretary Arun Jaitely met Chief Election Commissioner N Gopalaswami and formally submitted a memorandum signed by 180 NDA MPs demanding Chawla's removal by the CEC exercising powers under the Constitution.

"The petitioner believes that on account of the background of having a close proximity with the Congress party and its leadership, Navin Chawla lacks fairness and non-partisan approach in dealing with political parties.

"The factum of his lack of fairness is best known only to the CEC and, therefore, his recommendation is only condition precedent for any action. This recommendation may be suo motu by the CEC or it may be on the basis of information available with the President or on basis of a complaint or petition filed by a third party," the petition said.

The BJP moving the Election Commission comes after its earlier attempts for Chawla's removal failed. First it approached the then President A P J Abdul Kalam with a similar petition, which the Government declined to forward to the CEC.

The party then followed it up by filing a petition in the Supreme Court where the Government took the stand that the Government was bound to forward it to the Commission, while the CEC maintained that if such a petition came before him he has powers to consider it. The Court then left it to the BJP to approach the CEC.

Jaitely told reporters after their meeting with the CEC that they have submitted the petition as per the directions of the Supreme Court.

"We had submitted a similar petition to the President which was forwarded to the Prime Minister's office. They didn't take any action," he said.

Citing provisions under Article 324 (5) of the Constitution, the petition maintained that an Election Commissioner can be removed by the President on the recommendation of the CEC.

"In the matter of removal of the EC, the provision gives primacy to the CEC and his views. The condition precedent for removal of an Election Commissioner is only one i.e., a recommendation to that effect by the CEC," the petition contended.

To substantiate its demand, the petition questioned the conduct of Chawla as a bureaucrat before becoming Election Commissioner.

It alleged that he was part of the Emergency "tyranny" in Delhi during the mid-1970s and his career-graph "progressed" only when the Congress was in power at the Centre or in Delhi and "nosedived" if a non-Congress government was in power.

The petition also claimed that in political circles Chawla was perceived to be "extremely close" friend of Sonia Gandhi and her family.

If there is even a whiff of suspicion about patiality of Chawla, if he is a honest gentleman, he should quit instead of vitating the political atmoshpere. If he doesn't quit then he should be forced out by CEC or Supreme Court. If neither happens we should seriously think of boycotting the next general election with him as CEC.

BJP is up again raking up petty issues which only exposes the hollowness of BJP which claims to be a party with a difference. The dead issue of removal of Navin Chawla from EC will not bring any fruitful results, because by applying its prerogative, CEC has already settled this issue once for all. It is time, instead of wasting its politicl clout on such irrelevant issues, BJP had done some constructive work for the good of the common man in the country.

You are writing this without assessing the seriousness of the situation. Sonia has appointed him knowing fully well that he has criminal mind, looking at his record of emergency excesses. And, Sonia wants such people only in high posts, so that she can get other criminal things done by them. Now, she has planted this Congress man in the supposed-to-be-impartial EC, so that he can take decisions to declare Congress to have won, even if the people vote out Congress, using all possible illegal and unconstitutional things (Navin Chawla has already proved to Sanjay Gandhi and Congress that he is only eager to subvert the Constitution, by doing that during emergency. Now, IT IS GOING TO BE A WAR BETWEEN THE PEOPLE AND SONIA. SONIA WANTS RAHUL AS THE PM, AND SHE IS DRAWING THE BATTLE LINES.. AND THAT TOO IN THE WORST WAY, BY APPOINTING HER LOYAL SERVANT-LIKE PERSON AS THE UMPIRE (EC). LET US ALL PRAY THAT THE PEOPLE WIN ULTIMATELY, AND NOT THESE CRIMINALS..

Do you know the credentials of Chawla? This man was in for-front during emergency putting behind all opposition leaders behind bars and doing all barbaric activities. He get EC position as he wrote a biography of Teresa, the christian evengeslist who converted lakhs of poor hindus by cheating, bribing and luring. Sonia rewarded him as old-guard of Congressi and a chrisitan missionary supporter and symphathiser.

BJP filed complaint to EC against Sonia for infamous 'maut ka saudagar' and other abuse to Modi. EC was silent. But they were prompt to serve a notice to Modi, when Congress made complaint. All this was done by Chawla. CEC was bulldozed by two Sonia appointee anti-Hindus Chawla and Qureshi. One is covert chrsitian and a muslim. Present EC is an overt and covert agent of Congress. Chawla the disgust must go. Else people will spit on EC.

Sonia has mastered the art of appointing the following type of people to important positions of power to govern us:(1) Downright criminals: Example: Shibu Soren. First time in the history of mankind that a Union Minister (or equivalent in other countries) who was ABSCONDING DUE TO MURDER PROCEEDINGS, AND STILL SONIA/CONGRESS WANTED HIM IN THE CABINET TO RULE US!!(2) People close to or protective of criminals, meaning abettors: Example: Pratibha Patil to the highest office of India; Look at the record of her Mahila bank and the record of her husband; SHAMEFUL(3) Party-minded people to supposedly neutral posts: Examples: Several governors who act blatantly against the constitution to keep up Congress governments (Goa, Bihar, any number of cases). And, now an Election Commissioner, so that there can be foul play even in such an important constitutional body like the Election Commission. It beats me as to how the country can be retrieved from such situations when the constitutional bodies are systematically subverted.. God save India... unless, we arise and VOTE OUT SONIA/CONGRESS
