The petition is likely to be filed tomorrow, lawyers associated with Ramdev said. Lawyers Suresh Sharma and Gandharva Makker said the petition assailing the High Court verdict was to be filed on Tuesday but was delayed due to "unavoidable circumstances".
They said the yoga guru has challenged the July 2 judgement contending that homosexual activities are not only against public morality, public health and healthy environment but also against the interest of the society.
"...homosexual activities which are otherwise unnatural there is high risk of exposure of a large chunk of population to dangerous sexually transmitted disease including HIV/AIDS," the petition, likely to be filed, said.
"The decision of the High Court, if allowed to sustain will have catastrophic effects on the moral fabric of society and will jeopardise the institution of marriage itself. This offends the structure of Indian value system, Indian culture and traditions, as derived from religious scriptures," it said.
Ramdev, quoting Spanish psychiatrist Enrique Rojas, contended that homosexuality is a disease that is curable.
"It can be treated like any other congenital defect. Such tendencies can be treated by yoga, pranayam and other meditation techniques," he said in the petition.
The High Court, in a landmark verdict, legalised gay sex among consenting adults, which was earlier an offence under Section 377 of Indian Penal Code with punishment up to life imprisonment.
The verdict had retained the penal provision for non consenting gay and homosexual acts involving minors. Ramdev, in his petition, contended that legislative mandate under section 377 of IPC did not infringe the right to privacy of persons indulging in homosexual activities as held by the High Court.
He maintained that section 377 is not violative of right to dignity of an individual and reduction in purview in the penal provision would aid in promoting homosexual activities which are primarily responsible for spread of HIV.
Ramdev said in the petition that the High Court has erred by adjudicating Section 377 to be violative of fundamental rights
"The High Court has erred in its ruling by interpreting the terminology sex as sexual orientation. In fact, the term sex referred under Article 15 is in relation to the male or the female sex. It can't be interpreted in context to the sexual orientation of a person," the petition said.
He alleged the verdict would promote homosexual activities which would adversely affect population growth in the country.
"Homosexual relationships, if encouraged, would bring population growth of a country to a halt and may deprive this country of its greatest asset of human resources," he said.

Dear all, Please thought deep about it that what are the matter of reality of life. We must accept such things which can develope our heart, mind,soul,and society. We must look once in our life that it is acceptable for our heart, mind,soul,and society or not if right then we accept otherwise not.I think this is not the issue of claim or blame to anybody/orgnisation.I think we mustn't accept it for a little group in India which may do a bad effect in the future for our generation .We must accept unless it is said by a begger or a novelist. If Govt released 377,rapidly a such of huge group will spread in India and real human culture of civilised in the society may be destroyed.
Swami Ramdev's actions have nothing to do with yoga or healing nor with the sanatana dharma (the eternal truth). His attempts to bring the sanctions of the criminal law against the life choices of others categorize him as an enemy of freedom and truth, willing for the sake of egotism to sacrifice the happiness and well being of millions on the altar of the god of self-aggrandizement.Some notion of the Swami's concept of and committment to promoting health might be had from his fraudulent claims of curing AIDS, cancer and - most egregiously - his promotion of a purported ayurvedic "medicine" labelled "Putravati," supposed to help women to selectively give birth to sons.Swamiji's efforts to promote the marginalization of homosexuality may well win applause in the homophobic, misogynistic backwaters of the subcontinent's countless villages and in the right-wing of India's politics, but the world now sees him for what he is, and that is no "man of God."

I want to know if modern psychology says gays are sick or not. I feel homosexuals are not sick because it is something natural to them. Like hunger comes naturally to me. What is natural and what is unnatural?? there are a zillion ways of looking at a thing.Transsexuals or hijras are not considered natural.But they are there ...very much the third gender.We cant deny them. Churan Chor,Although teh world belongs to everyone, nobody has given you right to live the way you want to. EVery socieity has its own culture and civilization and what is permitted and not permitted is spelt out clearly. It is quite possible that what a socieity feel bad is good for another socieity. Just because a handful people of the former society feel that since this particular actitivity is pemitted in 'X' socieity we should also be given permission to adopt it, cannot be justified if majority are against it. Either you walk out of that socieity and live separately or go with the socieity, honouring its DOs and DONTS.

I,agree with the comment made by Ramdev,despite disagreeing with Baba on the issue of gays and lesbians.I,wish more people in India had the integrity and moral fibre of Baba Ramdeo Maharaj,rather than the gutless wonders and their ilk who have repeatedly failed the country.
Baba Ramdevs challenge will help us understand the gays more.Whichever way we should look at this problem more compassionately.If the high court has said it is not legal, the we do need a a medical opinion on this.Please respect both sides then only can we understand this issue more
Atleast the Law-makers are aware homo-sexuality is abnormal act and is caused by psychic disease developed through circumstantial and enviromental influences on indivisuals characteristics in early age.Its also known that till the age of puberty there is fast change in hormones which are disordered in some because of dominance of other hormones than what they are.Mostly its because of neglection and wrong up-bringing of the children.The parents,the family and people in social circle play a great role to mould the orientation of the child through watchful study and sincere concern.This is not serious disease at the begining but once its let free,or say legalised,this becomes epidemic and cancerous.The cure is simple guidance,open and free conversation with children and through perpatual care and constant supervision.Children are like argil and parents are potters its they to give shape and temper to form character and decent behaviour.No legalisation for its abominable/a social crime

The above two comments are one sided. In my opinion research should be done on this aspect that whether Gay orientation is natural or not. If found natural, Gays should have equal rights as heterosexuals otherwise this orientation or discorder should be cured.
I think SwamiJi is right by moving the SC for this. The HC order will jeopardise the moral fabric of Indian society. Though I dont think it is a disease which can be cured, still we shall refraim from legally allowing this practice. Also, Section 377 is required to protect children from offenders. I think that HC has not fully understood the implications of this order, and a further scrutiny from the SC is justified. Besides, all religions prevelent in this secular India, do not accept this kind of activities. So SwamiJi is not favouring any religion but raising the voice on behalf of all religions.
