Babri report: Vajpayee, Advani, 66 others held culpable

New Delhi The top BJP leadership including Atal Bihari Vajpayee, L K Advani, Murli Manohar Joshi have been severely indicted and called "pseudo-moderates" by a Commission that probed the demolition of Babri Masjid 17 years ago.

The Justice M S Liberhan Commission of Inquiry also attacked former Uttar Pradesh Chief Minister Kalyan Singh saying, the destruction of the disputed structure on December 6, 1992 was carried out in a "duplicitous and under-handed manner" which was not worthy of a democratically-elected government.

The four-volume report running into over 1000 pages and government's Action Taken Report (ATR) on it were tabled in Parliament by Home Minister P Chidambaram, a day after a leak of the report in The Indian Express.

The Commission, which was set up 10 days after the incident and got 48 extensions, recommended a law providing for exemplary punishment for misuse of religion for acquiring political power and disqualification of political parties and candidates who have religious agenda.

It its ATR, government promised that a bill to check communal violence was being contemplated which will include provisions on some these recommendations while the Election Commission would also be moved to look into them.

The ATR spoke of no punitive action against anyone and merely took note of the cases filed against BJP and Sangh Parivar leaders in various special courts in Lucknow and Rae Bareli.

Unsparing in its attack on top BJP leadership, the Commission listed Vajpayee, Advani and Joshi in a list of 68 leaders of the Parivar and officials as responsible "for leading the country to the brink of communal discord" in their individual culpability.

It said there was no manner of doubt admissible in the culpability and responsibility of the Chief Minister (Kalyan Singh), his ministers and Sangh Parivar leaders like Ashok Singhal, K S Sudarshan and Vinay Katiyaar, who formed a "complete cartel" supported by the icons of the movement like Advani, Joshi and Vajpayee.

Kalyan Singh and his trusted lieutenants spared no lie before the highest authorities of the land to befool them and to tie their hands with the niceties of constitutional democracies.

The Commission analysed the standards of culpability and divided various persons and organisations into three groups. The first group represented those who bore the primary and greatest responsibility for the demolition as they had the means to prevent the assault.

The second group consisted of those who portrayed the benign face of Ayodhya campaign and gave false reassurances to the courts, the people and the nation as a whole.

"Those who have been put in the second category in these conclusions are referred to as 'pseudo-moderates' in contrast to the radicals forming part of the first group," the report said.

All these three groups, the Commission said had "managed to reduce one of the greatest nations and one of the oldest civilisations to the state of stark intolerance and barbarianism-- all for petty political gains".

As the inner core of the Parivar, the top leadership of the RSS, VHP, Bajrang Dal, Shiv Sena and BJP bear the primary responsibility.

"On the one hand, leaders like A B Vajpayee, Murli Manohar Joshi and L K Advani, who are the undeniable public face and leaders of the BJP and thus of the Parivar, constantly protested their innocence and denounced the events of December 1992. On the other hand, it stands established beyond doubt that the events of the day were neither spontaneous, nor unplanned nor unforeseen overflowing of the people's emotions, nor the result of a foreign conspiracy as some overly imaginative people have tried to suggest," it said.

Maintaining that it was unable to hold the "pseudo-moderates innocent of any wrongdoings", the Commission said "it cannot be assumed even for a moment that L K Advani, A B Vajpayee or MM Joshi did not know the designs of the Sangh Parivar.

"Even though these leaders were deemed and used by the Parivar as the publicly acceptable faces and the articulated voices of the Parivar and thus used to reassure the cautious masses, they were party to the decisions which had been taken."

Observing that the pseudo-moderates could not have defied the mandate of the Sangh Parivar, specially the RSS without having bowed out of public life as leaders of BJP, the Commission said this BJP leadership was "as much a tool in the hands of the RSS as any other organisation or entity and these leaders stood to inherit the political successes engineered by the RSS."

Referring to Govindacharya's famous mukhota or a mask remark, the Commission said it may be "more appropriately applied to the BJP leadership at the time collectively."

"Without leaders like Joshi, Advani and Vajpayee, the RSS might have been able to achieve de facto clout, but would not have been able to legitimise its hold on the Indian system by translating that clout into political success," the report said.

The Commission said these leaders cannot be given the "benefit of doubt" and exonerated of culpability. "There can be no grated betrayal or crime in a democracy and this Commission have no hesitation in condemning these pseudo-moderates for their sins of omissions."

Virtually giving a clean chit to the Central government that was then headed by late P V Narasimha Rao, the Commission found that the Centre was crippled by the failure of the intelligence agencies to provide an analysis of the situation.

"It stayed its hand deferring to the honourable Supreme Court which had taken up the matter was dealing with it by giving appropriate directions. The Supreme Court was in turn misled by the pretentious undertakings given by the Uttar Pradesh government and leadership of the movement and the all-is-well reports by its rapporteur Tej Shankar. Without proverbial leg to stand on, there was little either could have done to forestall the determination of the perverted guardians of democracy, who were in control in Uttar Pradesh," it said.

The Commission also came down heavily on the use of the security apparatus by the Kalyan Singh government and how it was systematically ordered to desist from use of force or resort to firing in any circumstances against the karsevaks or their leaders.

"When push came to shove, the senior police officers were at hand to ensure their men toed the line and that the demolition of the disputed structure was allowed to go ahead with military precision as orchestrated by the leaders present at the spot and carried out by their henchmen whom they refused to identify even before me," Justice Liberhan said in his report.

By far the worst sin of omission of the state government was leaking into public domain the information that the police personnel had been hobbled and would not react or retaliate under any circumstances.

Emboldened by the self-confessed handicap of the law enforcement agencies of the state, the karsevaks enjoyed a free hand aware that they were at zero risk from them.

"Even the forces demanded by the state government and sent by the Central government for security purposes were intentionally taken away from the scene and deployed at far away places under the garb of meeting the threat of terrorism," it said.

The Commission also questioned the role of the Supreme Court observer in not alerting the Court to the clearly unfolding duplicity and said it was something that raised concerns about the impartiality and objectivity of the officer who was handpicked by the state High Court.

"Even at the moment that the domes were being pulled down, he was not at the spot, having been delayed by his family members whom he had brought along to witness the spectacle," the report said.

The Commission also had some words of criticism for some "selective communal Muslim leaders" obsessed with personal or individual influence for enhancing their political influence and self gain for being merely bystanders during the entire period and put forth dismal performance.

The Babri Masjid Action Committee never set up or presented any claim to the disputed structure in any negotiations and there stand was a merely simplicitor denial of the claims of the Sangh Parivar.

"The Muslim leadership provided the rabid Hindu ideologues sufficient cause to instill fear into the common citizens of India," the report said adding the elite political Muslim leadership was neither responsible nor caring for the welfare of the community."

On the Commission's recommendations for establishing a Criminal Justice Commission for monitoring the performance of all law enforcement agencies, government said Law Commission will be requested to study the proposal.

Justice Librahan commission report clearely mentioned that the sangparivar groups are responsible for the current didided thinking among the Indians. Before Babri Masjid demolition most indian were not considering thier fellow indian's religious background. But now every where it reflects because of these devil thinking peoples. indians has given right lesson to those peoples ih the recent election. Let India be a peaceful nations & let indians achieve great things in the future.

Hi Friends, I really appreciate your views that still there are people who believe that BJP had given us the best government in the last 60 years.A party who has started its journey with few people in hand and made it to parliament is not a joke.Mr. Vajpayee is the best Prime Minister in indian parliament.He is not like Gandhiji or Nehru who led the country towards partition only to fulfill there dream of power.This seed of bitterness between Hindus and Muslim is grown by the Gandhi and Nehru and even today the congress is playing the minority card.Today India is facing the problem of population and unemployment, does congress is able to make a law for population growth check and the answer is NO.......... because it will effect its future that depends on minority.It is Congress not BJP who always divide people on the basis of religion.

After naming Vajpayee and not naming Narsimha Rao THe report shows its political colour.Even a third grade layer knows ass per natural law of justice without hearing anyone no one can be held guilty.Without summoning vajpayee even once mentioning him at all pages shows mental bankruptcy of retired judge who wasted crores of taxpayers money so that he can have a job for 17 years after retirement.

400yrs back Babar demolished mandir and built the masjid. Nither Hindu sentiments were hurt nor it was anti national at that time. Masjid demolished for building the same mandir, Muslims got hurt. And the issue became anti National. Now our intelligent brothers will cry, why demolished masjid and threw country into riots.was there really a temple etc etc. The new issue is coming. Afzal khan attacked to kill shivaji. He was not saint. He was a devil. Shivaji killed him. Yet today, home minister says that prior permission is needed from police to show picture of shivaji killing Afzal. Why? Muslims will get hurt.Means again showing pic without permission will be Anti National.After some yrs, this congress will remove the chapter of Afzalkhan killing from history book and will give national holiday for death anniversary of afzalkhan. And opposing that will also become antinationl. And to that oppose, our intelligents will say Y throw people in riots by opposing. Lets accept Afzal as saint

This is nothing to insult anybody's religion. According Hindu archeologists, the existence of Ram Temple or Ayodhya at the subject site has not proven. This offer to our Hindu brothers will be on the table for tje next 100 years. Prove it. Not emotionally, but scientifically.

Blab la bla%u2026bla bla bla This kind of politicking can happen only in India. Not in Pakistan, Bangladesh, Kashmir, Malaysia or any other islamic country. We have the habit of slumbering. We are on the defensive always though we know what the truth is. One example: Lately these guys who have no regard for the truth have been claiming that Vande Mataram is not in the spirit of Islam. My question is: Is the Taj Mahal, dedicated to a human being, in the spirit of Islam? Isn't it rather one of those temples appropriated by the moghul conquerors and converted into a monument? Another example: Roughly a couple of years ago the tallest Buddha Statue, in existence for over a millenium, was mercilessly demolished by the Taliban in Afghanistan. Does anyone remember? According to Wikipedia the Swiss government had offered to have the statue transferred to Switzerland, but their offer went to deaf ears. It is an incident that happens in our times yet I haven't heard of any commission of enquiry!!!

Without a shadow of doubt there is an element of truth in this 17 year old report.However,the ruling Congress government has not upheld the recommendations of the Srikrishna commission despite Sonia Gandhi's assurance to Mumbaikars in Mumbai not so long ago.Unfortunately the newspapaer leak and all the other shenanigans going on around this report,despite all our hard earned taxes and the painstaking effort of that poor judge,I cannot see much light at the end of the tunnel.Will the Congress and all other political parties now dissassociate themselves withe religious lobby.Will the Congress severe it's ranks with the Christian lobby and the Muslim league in Kerala?Will Mr.Mulayam Singh and his ilk stop wooing the muslim votebank?I hope this report will make all out r politicians to stop and think of the havoc they are creating by their devious political games.We don't need Pakistan as our enemy,we are our own worst enemies.

The commission report is very late. As the saying goes justice delayed is justice denied. The fact remains that BJP leadership went on a rampage to propagate communal agenda. So many innocent lives were lost, a religious place desecrated and much communal hatred spread. The end result-where are they now? back to where they started. I am wondering if the congress backroom boys who manage all strategies are embrassed by Liberhan report, as it did much more than they wished! Just look at the new word coined by 'Justice' Liberhan "pseudo-moderates"... Is he retorting to Advani for coining 'pseudo-secular' word? Why? on Whole behalf? I am sure even lowly live forms like Law minister Moily will not stoop to this level.... Everyone knows the following: (1) Hindus are voting based on various caste/language groups so 12% muslim votes (20% in actual voting ) become v importan in divided polity, where 30% votes can make one win. So so called 'secular' politicians never had a real mandate ever.. (50 %). It is all western controlled media creation, the congress landslide/comeback etc. Of course west wants white christian to rule, best option after British. (2)When hindus are in minority, first casualty will be congress. Look at Kashmir, it is not secular Congresss which is a force, but muslim PDP or NC.

Politicians all over India resort to religion, caste to whip up sentiments to get them elected to public office. this is finest and most criticisable case of induction of Mr Vajpayee by the liberhan Commission into the demolition of Babri Masjid which occurred 17 long years back. not even single person was thought that Mr Clean Vajpyee the second most populer prime minister and political leader after Indira Gandi even today also he stands first in rating far ahead from the leaders. this clearly a political motivated and backed induction. it is very unfortunate that even after so many yaers and expenses the liberhan commission didnot give fair immpartial and report about that incident. therefore i termd it as this commission is a stigama on the name of enquiry commissiion. i criticise the very induction of Mr Vajpyee's name by this commission. the main person and the government and person who was supposed to be only held responsible for the said incident was the congress and then prime minister sri late P.V. Demolition of Babri Masjid is the best thing that happened in India.Minority would never have agreed to remove the structure from the disputed site.They never believe in give and take. Liberhan report implicating BJP top leadership will strengthen electoral prospect of BJP in coming elections. Congress will be looser henceforth. BJP must strengthen its Hindutva agenda.Only agenda remains before them is the construction of Ram temple. Mixing religion with politics or mixing social issues like reservation are all evils and brought in play to further electoral prospects.So no party should be spared from disqualification.Liberhan report is blessing for BJP and SS.

I wonder whether Justice Liberhan will be able to adduce conclusive evidences for the involvement of leaders like Vajpayee in the babri masjid demolition. It looks to me that the observations of the commission are all based on conjectures and will not stand the scrutiny of law. The only unfortunate thing about the issue is that these observations have been made by a a retired judicial officer.It is afterall the passage of time that will be the sole determinant of the right and wrong side of an event

Advaniji's rath yatra finally ended on Raisina Hill in 1998. It ensconced Vajpayeeji in South Block for six years and Advani in North Block. The demolition of the Babri Masjid, the communal riots, the serial blasts were all milestones on this grisly journey. Difficult to see how the greatest beneficiary of this enterprise could float, lotus like, above it all.

Yes you are right, why Babri Masjid was not demolished in 1947 violence and got demolished when Advani's started Bharat Rath Yatra. Mulayam Singh came with farman for Muslim Masjid nahi baey gee, why he wants to instigate Muslims. It's his right express as Hindu Mandir will be built but not tell Muslim they can not built Masjid there and make them believe Muslim have come from out side.
