New Delhi In an indication of government's thinking that it may not accept the CEC's recommendation for removal of his colleague Navin Chawla, Law Minister H R Bhardwaj on Monday said N Gopalaswami should do his job in the EC and not behave like a "political boss".

Bhardwaj said he had received a file on the matter. "I have to see what is new in the matter," he said, adding the internal tussle within the Election Commission has been going on ever since Chawla was appointed to the post of Election Commissioner.

"Gopalaswami should do his work in EC and not become a political boss," he said on the sidelines of a conference in New Delhi.

Asked if the government had taken any decision on the Chief Election Commissioner's recommendation to remove Chawla, he said "When a decision is taken, we will inform you," adding "the EC's role is to prepare electoral rolls and not to settle scores".

The Government has taken a dim view of Chief Election Commissioner (CEC) N Gopalaswami’s report to the President recommending the removal of Election Commissioner Navin Chawla—especially its timing, barely weeks before the notification of general election—highly placed sources have told 'The Indian Express'.

The sources said it was very unlikely that the Centre would act on the recommendation. Plans to appoint a new CEC from within the present EC after Gopalaswami’s retirement on April 20 remain unchanged, they said. Navin Chawla is expected to succeed the CEC.

The Congress, which said it was studying the issue, on Sunday indicated its resolve to back Chawla all the way.

AICC spokesman Abhishek Manu Singhvi also pointed out that Gopalaswami had been handpicked by the then Home Minister L K Advani to be Home Secretary before his appointment to the EC, and that there appeared to be a “remarkable congruence” between his views and the BJP’s.

Well, are we going to hold on to technicality and allow the Chawla to do what ever he wants to do. More over, make him CEC. I am not sure what the agenda for the congress is here. They are making sure that all offices will be tainted. They have already done that to the highest office of this country and they will not leave any office.

Law Minister H R Bhardwaj is a minister for thieves. It is a shame that India has produced such a criminals who is now the law minister. It is no wonder that the fourth rate fellows end in legal profession in India and they have no shame or integrity. H R Bhardwaj’s ministry allowed the bofors pay off to Sonia’s boyfriend Quattrocchi to be defreezed against our national interest. Additional Solicitor General (ASG) B Datta, in February 2005, attested a CBI affidavit about the genuineness of the Swedish documents regarding Bofors kickbacks as well as the admissibility of the very same set of documents. The documents were authenticated by the justice department of Sweden and is admissible. But after taking bribe ASG, B Datta, in May 2005 changed his stand and stated just opposite of his version before the court that the documentary evidence against the accused was not authentic and hence not admissible.

Anyone who has no bias would observe that 1. The congress ruled this country for almost 58 years either singlehandedly or through coalition with other parties.As such the major part of blame if any should go to them for the bad culture developed post independence.2.Forget about many other offices, even the offices of the president and governors that were supposed to be occupied by eminent persons disconnected or at least unbiased from politicians were gifted to undeserving local politicians for silencing their voices.The legacy continues...the office of the EC must be occupied by a person who can save the present government from the common voters since they are witnessing 'secularism' that favours a specific religion,'security' that is only for the VIPs and not for victims of attacks /bomb blasts as in Delhi, Bangalore, Mumbai, Guwahati and many other places, economic progress of politicians and their cronies and finally 'reservations' for only those who have the power of nuisance!

One former CEC is now a Congress Rajya Sabha MP and Sports Minister of India, another former CEC fought as a congress candidate against shri LK Advani from Ahmedabad. A former chief justice of supreme court was elected as a congress member of rajya sabha from orissa. So, Shri Chawla has been partial throughout his career starting from the days of emergency. So, if Gopalswamy says that he is unfit to become CEC he is doing the right thing. Congress Party is not known in India for encouraging institutional autonomy so it is natural for Mr Bhardwaj to make derogatory remarks aganist a constitutional authority. It is Mr Bhardwaj who must be sacked first.

Congress as completely destroyed every democratic institution in this country. PM Manmohan Singh saved his chair by bribing 25 crores to each MP during last confidence motion. Now the congress is supporting chawla. Chawla's name is infamous for being a henchman of Sanjay Gandhi, and his excessess during emergency are well documented in the Shah commission report set up by the Morarji Desai led Janta Party government. That emergency, in essence was anti democratic and that Chawla was its supported indicates that he has no right to be in EC which is the highest democratic instituion in the country. The remarks by Bhardwaj are absolutely disgrace. How can he speak against person who heads the August body. This is Congress gutter journalism at its best. As usual the media is supporting the wrong doings of the congress.

Our MLAs, MPs and other powers that be usually parrot "law will take its own course", although it is well known that in India the law has already reached 'menopause' when it has to hit the interests of the powerfuls. There will be number of examples when the law has got stuck at a point, in order only to save the big criminals. As a citizen one expects, at least our law minister to respect the idiom that "law will take its own course" and not try to poke its wheel. Why all these worthies are bothered only about the timing only and not on the significance of whatever the CEC has cited in his letter? The left is also concerned only about the timing when its State Secretary is charged in the SNC Lavlin case. The BJP also might have said similarly when its interests were at stake (ask any hardcore congie or leftie for instances). God save my country from these "servants" of the nation.

Mr. Bharadwaj has always fooled the Indian people and lied to keep his post. The constitution of India does not provide for the law minister to embarass the CEC either. So what the fish is Mr. Bharadwaj is doing talking about the CEC. The constitution provides for the CEC to make a recommendation, SUO MOTO OR OTHERWISE IS NOT STATED - just says he can make a recommendation and he has made a recommendation likewise. The Government is bound by it - but we have this Government of puppets of a white lady from Italy, that has always tried to violate the sacred Indian Constitution and deny its people its rightful freedoms and has curtailed independant offices inclduing the judiciary!So nothing new. I just hope the Supreme Court will act Suo Moto in the matter and kick out a politically and morally corrupt Navin Chawla.

Mr. Gopalasawamy is a officer of great integrity and has carried about his work with great dignity. I am surprised with the way that Congress and the other "constitutional experts" have reacted / blamed CEC (don’t forget the most un constitutional party – Communists). What if Mr Navin Chawla is indeed guilty ? Where does the question of "political bossing", "timing" come ? The remarks by law minister is extremely unfortunate. It seems to me that he has passed a judgment before going through the merits of the case. Congress has been over the past 60 years monopolized the Indian Bureaucracy. They have made the president's office, the governers and other constitutional posts a joke. Now I am worried about the next CEC, if its a Congress 'yes sir' candidate, gauging by the trend in past 5 years and the current 'indications', we are back to the emergency era... the God save India.

The public should file a PIL in the Supreme Court if the Government does not act. We have a puppet President, also elected by the Congress, who forwarded the CECs objections to the PM who is also from the Congress, which is the beneficiary of all favours from the tainted Navin Chawla. The country is losing its bearings, because lousy leaders like Sonia and her cronies. Sad day for India. A PIL is a must if the Goverment fails to act!

It is unwise and undignified to comment on President of India. The position, stature, and powers of a President of India do not come by personality. The duties and powers of President of India are well defined in our constitution. Nothing a President can do with out the advice of the union cabinet "how ever personally powerful" he or she is. Even if the Parliament is dissolved after the fall of a government, the President needs a Counsel of Ministers on whose advice he or she has to act. A Governor can rule the state under President Rule with a team of Advisors So let us not drag the office of President and give bad words to it and degrade the highest institution of our country. In this case, the CEC and others in the insitution are taking political lines or not is to be debated. In simple common sense logic when one of the EC has been made as a Chief to head the institution, his recommendation should have weight in the functioning of the institution as a head of the institution (I think it is same as I feel). If you have any suspicion of the CEC and his functioning, you impeach him in the Parliament, I think as per the law. As one suggestion has come we need to get the directions of Supreme Court on this regard when the issue getting partisan lines. Similar incident(s) had happened in the times of Mr. Seshan and he had abided to court ruling. On the whole, the CEC must have some say in the functioning of the institution and others working in the institution. Then only the santity and the power of the Insitution is protected.

It's no wonder Bhardwaj wants a pliant CEC. Wasn't he the ‘ever-more-loyal-than-the-king’ servant who ordered de-freezing accounts of her majesty’s friend Quattrocchi? And even without consulting the investigating agency CBI which had gotten the accounts frozen. If her majesty could not trust Pranab Mukherjee to officiate as PM for a month, would she countenance a punctilious CEC?
