Charges against Bhajji can't be dropped now: ICC

New Delhi, January 14: While Brad Hogg is celebrating after India withdrew charges against him, Indian off-spinner Harbhajan Singh stands no such chance even if Australia wants to reciprocate to India's goodwill gesture.

Even if Australia suddenly has a change of heart and decides to withdraw racism charges that earned the spinner a three-match ban from the Match Referee, it's too late, according to laws of the International Cricket Council (ICC).

According to a source in the ICC, once the Appeals Commissioner is appointed, the process would complete its full course, even if the complainant wants to drop the charges.

"In Hogg's case, the charges of abusing the Indian players were laid by their administrative manager Chetan Chauhan, who later withdrew it," he said.

"But in Harbhajan's case, the charges were brought by both the on-field umpires, after which ICC has already appointed John Hansen as the Appeals Commissioner. The process would go the full distance in this case", the source said.

Harbhajan was slapped with a three-match ban by Match Referee Mike Proctor who found the Indian off-spinner guilty of racially abusing Australia's Andrew Symonds during the ill-tempered second Test in Sydney.

Harbhajan has decided to appeal against the ruling but the ICC has still not fixed a date for the hearing.

24th November 2007, Assam, India.what happened ?nothing... ? one person died ? .....sheeeh sheeh...nothing happened.....Biggest democratic nation in the world ?India who boast herself as the biggest democracy in the world should look into the scenes and pictures flashed across the nation of crowd stripping and chasing an adivaasi woman in Assam.Now, videos also showed adivaasi men being cruelly beaten to death by the local throng, while policemen simply stand sedentary. Indira Goswami who is a relevant social activist simply said it is very unfortunate and said, she want greater transparancy ???State government, run by Congress whose national leader itself is a woman, who claimed to have gave up PM post for the greater consciousness is sitting blind on these issues ? maybe there are cast politics and subsequent vote banks to be taken care of ....what about the oppositon party who wants India to regain the past glory ? how can a rape of Indian adivaasi woman go unnoticed by those who want indian women to be worshipped as gods ? why do they keep mum ?what are we doing by demanding PERMANENT POST in United Nations ? what can a country give when its own women citizen is stripped and chased across the streets ? Is this the country where Mahatma Gandhi lived ? what happened to his ideologies ?First Woman President of India - Prathibha Patel - why cant she do anything about this ? Is Tribals and lower cast women and men not protected by any laws ? Or is that they dont have a claim over this nation ? why cant a president ring up the Assam Chief Minister and ask what is happening there. I am absolutely astounded that a country that has suffered racism in the past, is now supporting racism itself. No amount of spin-doctoring can hide the fact that Symonds has been racially abused- both by Indian fans when he was in India and by Harbhajan in Australia. Is your cricket barracking so important to you that you will abandon any sense of moral outrage that racism is being accepted by your own cricket team? The Australians were lucky in Sydnety to get a few dodgy decisions go their way, can you in your heart tell me that never happened to them before nuetral umpires in India? Does it give you an excuse to allow racism into your cricket team? I cannot believe even the comments here talking about blacks and negroes in derogatory terms. Waxer, there is no question of supporting racisim. The fact is that the brave Sardar (Harbhajan) did not use the word "monkey". So where is the question of condoing or not condoning racism. In fact you show utter bias by assuming that Harbhajan uttered the word at Symonds!! So don't behave as if you are speaking from a high moral ground!! Come on, don't act like Mr. Proctor: believe the Australians without corroboration and disbelieve the Indians without a fair hearing>

Someone wrote that Tagore or Bernard Shaw did not meet people like Ponting. I thought of not answering this because of its ignoramus nature. But later changed my mind and wish to ask, "Is Ricky Ponting worse than General Dyre?" If so, then hats off to Indian nationalism and patriotism. Tagore lived in the era of people like General Dyre. Hope this will answer something, if not everything. We are far from those age. I do not wish to go back to that age when my children will be called "monkey" by whites and non-whites equally, because India and Indians have agreed that it is not a big deal. I have to keep on writing to get the menace of racism out of the face of humankind. I worry about my children and other children's future.

Read some world history, before commenting. These countries are all divided in variety of ways. This is called civilization. Any great civilization stands on one thing that is called contradiction. In a way India is also a country which is based on a variety of contradictions, that is why there are people like pravinbhai and I can co-exist. Don't let the country go in a path where plurality is not appreciated. Say if any conduct of India or Indians violate human dignity. There is nothing wrong to show some dessent. Dessent is real patriotism. A recent example is John Kerry. If you know what I mean.

Last time I checked Voltaire was still a French living in England; basically a white guy. So to make our point we still need to turn to a white guy. This is ironical. Most importantly, Voltaire was a satirist, and mocked a lot of things which includes religion and authority (notoriously same in his time). So VK Shahi, read Voltaire before quoting from "quote" web sites. This is important. Can I quote a brown person? Tagore, perhaps. He said, "Patriotism can not be my refuge, humanity is. I'll protect humanity over patriotism as long as I live." Another quote, this one from a white guy, named Bernard Shaw: "The world will sound more peaceful if patriotism is taken out of humanity." I hate to quote, because both of them have said many many things just not these. Can we turn to the brown guy, I just mentioned and be civilized? Tagore's quote is from a book written by another brown guy, named Amartya Sen. Hope this bring some sense to those who still believe racial slur can be supported.

The arguement by the ICC is the most rediculous to say the least. Even after a case goes before a supreme court or to a commisson it can be withdrawn by mutual consent. I suppose the ICC is trying to show who the boss is and in doing so it will expose itself as the object of redicule.

Mr. RajaI do not agree with you that BCCI has taken the steps you are suggesting. The stand taken by BCCI, even thought many like me will not agree to the same, is to withdraw charges against Hog to ease tension and let things move on. As far as you saying Sledging is part of game, but not the racism, I would say that both should not be part of the game in any way. because both are two sides of the same coin.I did not want to respond to you but had had to do so after seeing your multiple posting which I belive is your view from white people's prism.

Do we Indians really have any character, that we are still supporting Harbhajan Singh's racial slur? Is there anybody out there in India who has the guts to come out and say that it is nearly impossible to support racism? Is there anybody in India to understand the differences between racist remark and sledging? I don't believe that we Indian's are so poor in judgement, but willing to accept that they are primarily driven by a nautiating nationalism to separate their brain from gut. This is measurable. My request is that no matter who, if there is a racial slur, we all must come out to protest it, not support it. I strongly hope my Indian counterparts realize this simple, but powerful suggestion, and act in a more civilized way. Just saying 'mera bharat mahan', does not make 'mera bharat mahan.' We do not wish to cling to some slogan and ignore humanity altogether. Please grow up and learn the world. Racism is a curse to human society, just like castism in India. None has any place in modern civilized society. Please show some respect to human beings, not just Indians. Get this straight Indian cricket lovers, cricket world is little and is dictated by the subcontinent (India, Pakistan and SL); no other country give a shit about this sport. The subcontinent has the most viewer and power on the world cricket body, not the Europeans or Astralians or West Indians. The majority of the money in cricket comes from those three countries, please don't let these countries abuse their power to bully internation code against racism.

To say, that Sledging is acceptable and racism is showing the fact that you have graduated to a level of White's mentality. It will be a blunder on ICC's part if they don't handle Harbhajan's case satisfactorily specially when the Indians have given hell of a lot away hoping to keep the spirit of the game. It is high time that the ICC members are scrutinised for fairness to all the teams including India, Pak and Siri Lanka. ICC always favours the white teams and they are so used to it that they don't recognise that India and Pak pays their wages now. ICC membership must now be on the basis of who generates more money for cricket and not just the colour of the members. There will be chaos if Harbhajan is not fairly treated. He has been found guilty on the say so of two Aussies and Indian crickters of the status of Sachin were not listened to. Again white mans justice!!
