In the first case, the accused and the victim claimed that they were in love and had even “got married”. But an FIR was registered in Najafgarh in November this year after the girl’s father complained to the police that she was a minor.
The girl later told the court that though she could not prove her age she was past 18 years of age. The court also took into consideration the fact that the victim was in advanced stage of pregnancy and abortion was not an option.
In order to ensure the victim’s welfare and the still unborn child, the court ordered that since the accused and the victim claimed to be in love and the victim seemed more than 18 years in age, they could marry.
Additional Sessions Judge Kamini Lau also ordered that a fixed deposit of Rs 30,000 be made in the name of the child, which could be cashed only when the child turns 18 years. The court also ordered that the interest accruing from the sum should be spent on the child’s welfare; in case of any dispute or if the child does not survive till 18 years, the mother would be able to withdraw the money.
In a similar case, another couple also got married today after court was not satisfied with wedding photographs that they had produced in the morning. A case was registered in Dwarka earlier this year after employers of the girl told the police that she was a minor and had got pregnant.
While the police registered a case of rape the victim in her statement to the court insisted that she was in love with the accused. The victim and her family members also insisted that she was not a minor. Taking this into consideration the court asked for the opinion of the families of both the victim and accused.
The court allowed the couple to get married after the families and the couple expressed their desire. The court also asked the families to make a fixed deposit of Rs 35,000 for the yet unborn child - the child would get the amount when turning 18.
