New Delhi A Delhi court on Saturday ordered registration of FIR against Hurriyat hawk Syed Ali Shah Geelani, writer Arundhati Roy and five others for allegedly making anti-India speeches.

"The Delhi police is hereby directed to lodge an FIR under relevant provisions of the Indian Penal Code and file a report in this regard on January 6, 2011 the next date of hearing," Metropolitan Magistrate Navita Kumari Bagha said.

The court rejected the status report submitted by the Delhi Police which said no offence relating to sedition and other charges were made out against Geelani and others.

It said there were prime facie cogent evidence against the accused and asked the police to further investigate the allegations and file a compliance report.

The court had earlier pulled up the police for failing to submit proper status report on the complaint filed with them on October 28 by Sushil Pandit seeking registration of FIR against Roy and Geelani.

Besides Geelani and Roy, the complaint sought prosecution of five others, including Delhi University professor S A R Geelani, who was acquitted in Parliament attack case, and Sheikh Showkat Hussain, a professor of Jammu and Kashmir University.

According to the complaint, the accused made the comments at a convention here in October on 'Azadi -- The Only Way'. Hurriyat leader Geelani shared the dais with Roy and pro-Maoist leader Vara Vara Rao among others. Geelani was heckled by the audience.

The complaint filed under Section 156 (3) of the Criminal Procedure Code with the court on November one alleged that the government had miserably failed to initiate any action against the "culprits of the anti-India seminar so a private complaint against them has been filed".

Free speech by Rajesh on 27 Nov 2010

Judges are expected to uphold people's right, freedom to speech being fundamental. Unfortunately these judges are behaving like extremists. Shame on them.

AT LAST COURT INTERVENES TO REGISTER CASE by RAJAT KUMAR MOHINDRU .JALANDHAR CITY .PUNJAB on 27 Nov 2010

The Indian Constitution provides Right to speech , Right to Expression to every citizen of India but do not permit to comment issue that can be defamatory , As these defamatory comments irks the Indian masses , As Mr Geelani and Roy had quoted comments in regard to the issue of Kashmir and sharp reaction was witnessed by the Indian masses . As the Government of India refrained to direct the admnistration to register case against both for anti India speech , The court intervened and directed the competent authourties to register case against both of them who were indulged in controversial anti India speeches .

FIr against Arundhati by PKDutta on 27 Nov 2010

It is a pity that the HC has asked the police to file a FIR against Ms.Roy. We boast of freedom of speech and when Ms.Roy spoke openly she is being accused of sedition. It is highly unfair. Any patriotic Indian should be proud of upholding our Freedom Speech principle. Arundhati Roy did not do anything wrong.

fir against arundhati by ananda on 29 Nov 2010

freedom of speech does not mean you can say whatevr you want you can say. the interest of the country is paramount even if it means gagging people like arundhati for her senseless utterances done only for the sole purpose of sensationalism. what has arundhati done for the country till date? she just piles on to some ongoing agitation to gain publicity. remember, she joined narmada andolan after medha patkar had pioneered the andolan. have you heard anything from arundhati about it in the recent past? people like arundhati should boycotted socially. let her go and live in pakistan and see how tolerant and liberal india is.

Don't arrest them by Krupa on 27 Nov 2010

Don't fall for the trap. Don't arrest these traitors. That is exactly what they want. Get arrested, be famous, get more awards, money, fame, everything. Let these dogs bark as much as they want. Just ignore them.

Jail the Traitors. by Dinesh on 27 Nov 2010

Court should give Arundhati Roy and Geelani severe punishment and should be treated as dangerous and traitor of the country. India could not allow them to spit on the sacrifice of 100's of Freedom Fighters and 1000's of Security Forces.

Some blessings in disguise by rajmohan k on 27 Nov 2010

Finally the judiciary has atleast tried to show to people that they do not approve these ant-national characters like Arundhati Roy and Geelani....Good! Because we cannot expect the pseud-secular Matha Sonia and the puppet PM to take any action against these anti-nationals, which was very very evident from the reactions made by the congress leaders...."Arundhati Roy and Geelani's remarks should not be taken seriously"... The congress can only say this, because the 'votebank' community should not be made unhappy, be it at the cost of the country and the people... That's why the congress govt. has directed the Delhi police to not even file a petty case against these anti-national elements. It is high time, that we throw out the Arundhati Roy and Geelani type characters to Pakistan. Let them go and live in Pakistan, that place suits them better.

COURT ORDER AND PC by N.ASTI on 27 Nov 2010

Mr Chidambaram Your version(For suspicious reasons) for Geelani,Roy and others in the case of sedition gets proved wrong by Court's order.UPA Govt also gave you consent(Silence is consent)to help splittists thro' remaining mum on the issue.Does it not mean you acted against the Nation and pro-separatists?Should all such people not drown themselves in Arabian Sea at the earliest?
