New Delhi The Delhi High Court on Friday quashed the Centre's notification banning smoking scenes in films, saying it violated film-makers' fundamental right of freedom of speech and expression.

"Director of films should not have multifarious authorities breathing down their necks when indulging in creative act," Justice Sanjay Kishan Kaul said striking down the rules framed by the Centre in October 2006 for banning on-screen smoking.

Justice Kaul passed the order as an umpire judge after a division bench had earlier given a split verdict on the petition of Bollywood Director Mahesh Bhatt challenging the curbs imposed by the government.

Smoking Scenes in Cinema by Piranvez irani on 23 Jan 2009

I think it makes a lot of sense. While the governments move is well intended, it has no right to try and control all aspects of the peoples lives. Some things should e left to the better judgement of the people. Stiffling creativity in the name of the larger public good just because the government does not have the resources to cater to the heath nees of the populace is not the right approach

smokng scencs in movies by nancy chhabra on 26 Feb 2009

ya i agree dat govt has no right to control all aspects of people life, bt film makers shuld also think sumthng before emphasasing the smokng scens in movies, when dey know dat dese scenes effect not only teenagers but adults also. so i thnk d only measure dat can b taken is to ban all the smokng scencs in movies coz dey affect our society in one way or the other.
