New Delhi, March 14: In an apparent rebuff to Raj Thackeray's Maharashtra Navnirman Sena on the issue of North Indians, the Supreme Court asserted that every Indian has the right to settle anywhere in the country.

"India is not an association or confederation of states, it is a union of states and there is only one nationality that is Indian. Hence every Indian has right to go anywhere in India, to settle anywhere, and work and do business of his choice in any part of India peacefully," a Bench of Justices H K Sema and Markandey Katju remarked.

The apex court deplored the growing tendency of some sections in indulging in violence on issues that they differed on.

"These days unfortunately some people seems to be perpetually on the fuse, and are willing to protest, often violently, about anything under the sun on the ground that a book or painting or film has hurt the sentiments of their community," Justice Katju, writing the judgement, observed.

The apex court said such tendency leading to Balkanisation of the country should be curbed with an iron hand.

"We are one nation and must respect each other and should have tolerance," the Bench said.

Quoting Tamil poet Subramaniam Bharti, the apex court said, "this Bharat Mata has crores of faces! But her body is one. She speaks 18 languages! But her thought is one."

The apex court made the stinging observations while upholding the Gujarat Government's decision to ban sale of meat for nine days during a Jain festival.

let the supreme court say that "ILLEGAL MIGRATES FROM BANGLADESH SHOULD LEAVE INDIA...

Blessing in disguise--- by romesh.sharma on 15 Mar 2008

Agreeing with all who show deep concern for unity and oneness of the Nation but I do differ to critize or condemn, absolutely, the action taken by Raj Thackeray.I am not from Maharashtra and nothing to do with Raj or politics but to my conception this is blessing in disguise.Without his move the SC would have never given such statement and this problem of reginalism would have taken the worst shape if it wasn't addressed now.It was smouldering and could turn into wild fire. Now that they, the SC has realized the blunders committed by the Congress (now Congress led UPA)it must make ultimate decision about articles 370-A,b,c---and 371.It must clear the position in the North-East states.Quoting S.Bharti is not enough because there are and there were millions of this idealogy and make people realize and inculcate those feelings, which in other words is called patriotism, comes from examplary characters of the guardian of the Nation. They got to be honest and without vote-bank policy.

Ethical Governance by SKannath on 15 Mar 2008

Every Indians have right to settle anywhere, its one of the greatest assertion by Supreme Court, hope it will be helpful in democratization of Indian politics, bringing to an end feudalism, regionalism, castism in Indian politics

Every Indian has a right to stay anywhere by MAYUR MARU on 15 Mar 2008

I am glad that the SC has addressed the larger question of "intolerance" by all altu-faltu aadmi on any religious/political/social/personal issues. Our Political/Social/Business leaders do not have guts to "take the bull by horn" sort of and negate such exhibitions. Its high time some one talked frankly about such issues - the genral public must start "gandhigiri" against such moves by any quacks.

stop discremination by vinod on 15 Mar 2008

supreme court have given the right message to all politicians who wants to reap fruits making troubled water.its the mind set to be changed first.let the north indians know that south indians are indians first and more than they consider themselves,we never even spoke of seperate state or fought aganist our motherland even though north have many to say in this,so discreminating of south should stop.

SC and settlement by megh on 15 Mar 2008

does it apply to indians settling in kashmir?

Supreme courts pronouncements by s.divakaran on 15 Mar 2008

The Supreme Court has delivered many judgements defending natural justice.Yet the Governments have just ignored them and passed new legislation like the 69percent reservation in Tamil Nadu.

SC Stance by Dr.Sumanth on 15 Mar 2008

SC never takes southern india taken for granted. Including Maharashtra. Since most influential politicians are from North (including late Nehru). No matter what the regional community thinks, SC will always try to differ. It will pass laws saying anybody can stay anywhere and then will keep mum over article 370. Our Judiciary and politicians both suck. Added to it some channels like CNN-IBN will work towards dividing the country by only showing issues faced by minority. It will never expose majority mindset.

SC by Rajan on 15 Mar 2008

Why doesn’t SC speak so loudly about Article 370? If SC really believes that every Indian has a right to stay anywhere in the country they should show some guts and declare the Article 370 of our constitution unconstitutional which gives special status to Jammu and Kashmir. Article 370 effectively makes Jammu and Kashmir a country within country. It has passed laws based on this article that discriminate against outsiders. It has its own laws related to citizenship and it does not allow people from other states to hold property their. Above all Jammu and Kashmir has its own flag instead of the Indian flag. Why does SC not intervene in this matter, are they afraid of the extremists? If they are afraid then SC doesn’t have right to speak about this topic.

SC STATEMENT RE: RIGHT OF DOMICILE OF EVERY INDIAN by munn on 15 Mar 2008

This discussion in itself speaks volume by the fact that we find a reason to even discuss it. WHY? By just being an Indian citizen, I can live anywhere i damn well choose within the perimeter of Nationanl boundry; what the hell there is to discuss? This persistant strain of REGIONALISM is the cause of PAKISTAN, BANGLADESH, KASHMIR(?). Are we heading for a day for further truncation of BHARATVARSH?munn

Why it tooks so long to make simple statement? by mydaksha.com on 15 Mar 2008

This statment supposed to come naturally from the day one of the crisis. When you have to act you have to act and react immediately not later. I suggest if you dont know how to run the country than you have to step down. there is no room for mistake many innocent people could have got killed. To maintain peace and united India, have to act and in timely manner.Rajesh Dharia

Need for court scrutinity for article 351 too by Raju on 15 Mar 2008

Yes, is right about this, it is time discuss the article 351 of the constitution to which takes away right of Indian citizens to live in J

ALL THE CITIZENS OF THE INDIAN REPUBLIC ARE CHILDREN OF MOTHER INDIA by S.Rameswaran on 15 Mar 2008

Raj Thackeray should take up the privileged role to build a modern ‘Maharasthiran Culture’ reinforcing the 'Multiculturalism of the Indian Republic'. Non-Maharasthirans also have a responsibility to show respect to the exquisite language, culture, and above all the history of the Marathas. The resentment of the Assamese and the people of other North Eastern states are due to offensiveness, disrespect, and arrogance of the Bangladeshi settlers: The ordinary people from Bihar and Uttar Pradesh are very decent but are mislead by very (influential) corrupt politicians and criminals from other states like Lalu, Mayawathi, moulana Mulayam …to nature the vote banks which breed violent conflicts between different groups. Non-Maharasthrians have a duty to show respect to the language, history, culture, and traditions of the Marathas and also should be more considerate.

Indians can stay anywhere except by Varinder Sarin on 15 Mar 2008

Except in Jammu

SC's Stance by Dr.Sumanth on 15 Mar 2008

why does this does not affect to Kashmir, Sikkim and North eastern states. why does people in mumbai suffer with limited resources and millions pouring in every day. what should the native mumbaikar do...SC is stance is injustice!

SC's stance on the right of all Indians to live where they choose to. by John T Mathew on 15 Mar 2008

We need more than tolerance; we ought to develop an appreciation of others and generous RESPECT for all.

Assimilate and respect local culture by jay on 15 Mar 2008

Exactly. And we can not do that by keeping ourselves aloof from local culture and language. If we like to settle in some other state, then we should accept local culture and language. Massive migration of some specific communities must not be allowed to enforce social and demographic changes in any state or city.

Article 370 is illegal then by Jatin Patel on 15 Mar 2008

Oh Yeah, then abolish article 370 and put congress leaders who enacted it and enforced it behind bars for discrimination of decades.

It needs lot to substantiate---- by romesh.sharma on 14 Mar 2008

Such statements come only after formidable combination of antipathy and fear of losing regional identity over rules the sanity which further developes into frustration and agitations.People in common hate the slogans of separatism and reginalism.Common people, which is 99% of Indians want and wish united India but during all these 60 years the Govts came and went but none had shown real concern except few words during Republic day celebrations or Independence day.Congress had never taken any interest to induce the sense of unity and to inculcate a respect for the constitution and law. They either simply slept over and enjoyed the power or worked with levity. How easyily said that EVERY INDIAN HAS RIGHT TO SETTLE ANYWHERE!Can someone from SC tell why there were two PMs in one country for more than two decades? Is it true that I or any body from rest of India can settle or buy some land or house in Kashmir? Is it not true that there are special restrictions to settle in Himachal? Is it not true Indians need special permit (Inner-line pass)to enter Arunachal? Can someone settle in Meghalaya,Sikkim,Mizoram Tripura as wished or at-all?GOI had committed great blunders and never bothered or had courage to address the foreseen problems of the Republic.Kashmir got complicated only because Nehru was too reluctant. The whole North-east region was long neglected(even today the Govt doesn't have much interest, atleast it appears so)and the consequences we see which are escalating fast. Why China is claiming part of;perhaps whole of it,Arunachal because of neglection, uncertainty shown by the Centre and the same silly policy of creating borders within own country. The reason told was protection of culture and insurgency of missionaries which is acceptable but for that imposition of hard and fast rule is necessary and not drawing line controls. If the Sc really means what it says there could be no better news in present plight of disturbed animus atmosphere in the nation.Let us see if the SC deletes the article 370----371 etc.

SC has no rules for USA! by Amar Shah on 14 Mar 2008

The Government of WB has mis-managed Nandigram for what ever resons. But this does not mean USA to point fingure at WB. Its an insult for INDIA. India can question USA managment and capture of IRAQ in the NAME of WEPONS OF MASS DISTRUCTION! WHERE are the weapons in IRAQ? Its a false menifesto for looting of IRAQ's OIL. What is the USA doing in Sudan? What is the USA doing for its own people who lost homes and lives (1000 shot to death while looting during the Katrina Hurricane on the USA south Coast)? Can they answer the n-number of attoricities in AFRICAN Continent under the "Mosquito Net Banner - Erridication of Malayria?" This is shear non-sense. THE GOVERNMENT OF INDIA if it is quite, for USA asking directly to WB Government is its Insult. Since the CPI/CPIM is aginst the Nuclear deal for money for USA, the USA cannot take INDIA for a ride! This is a direct involvement of USA in INDIA's Internal Matter! and should be reported to the USA Puppy UN!

How does it correlate? by jay on 15 Mar 2008

and how does that relate to this topic (of SC ruling)?????????

SC statement by karan on 15 Mar 2008

I agree internal matters are internal matters. But that does not justify Nandigram killings. If someone kills his children or wife inside his house its not an internal matter of your house. Its a criminal and public matter. Get it?.Further when the subject in discussion is a very holy issue called the unity of India, how can you have the mind to talk some very different subject?. Looks like you dont care about the issue and you care only about false prestige of the country- India means its people. And you dont care if India is balkanised. Pathetic indeed.

Supreme Court by D.A.ESWAR on 14 Mar 2008

The Supreme Court should clarify whether non Kashmiris can buy land in Kashmir and settle whether its rule of law is acceptable in Kashmir. All laws say they are applicable to whole of India except Kashmir. Instead of makinf cheap publicity statements Judges should deliver justice promptly and correctly

every indian by sahebrao on 14 Mar 2008

basically the role media is not proper in such issues it should not publicity to such nuicence like mns with this much publicity his purpose is served otherwise nobody outof maharashtra was knowing mns

Bharathi wanted an India with all the languages flourishing. Hindi people should understand that. by S.Balakrishnan on 14 Mar 2008

Good that they quoted Subramanya Bharathi. He was both an ardent devotee of Tamil and one who wanted to be part of India. They are inseperable for him. His right to speak Tamil and to make the Tamil language a world language with literature that will be envy of every other language and to be part of India that allows this to happen. Mass migration of any one section to another especially with an innate sense of the superiority of their language is wrong and is not in the spirit of Bharathi. India is one because we all want it to be one. When the Biharis go and settle in large numbers in Maharashtra or anywhere else they should learn the local language. Respect of the components of Indian languages and cultures are essential and Bharathi underestood it. But somehow the politicians ignore it. Let us assert the right of Indians to settle anywhere but let us provide facilities to learn the local language. Patna is not poona and Chennai not Chandigarh. Let us respect that also.

Cultures change by Jojo on 14 Mar 2008

Cultures change with time. Is your culture the same as it was hundred (or even 30) years ago? Of course not! You can not stop the change of so called 'culture' even if you break contacts with everyone. Everyone has something to contribute. So blocking people from settling in your state is no way to protect your culture.

Cultures change by unni on 15 Mar 2008

Rightly said. People think culture is something very stagnant. If so we will still be in the old stone age like some tribes in certain countries. Is that what we want?.

Cultures change by karan on 15 Mar 2008

Rightly said.

We must not impose change so far culture and language is concerned by jay on 15 Mar 2008

You need to understand that one is natural change and the other one is forced change. We can not and should not prevent natural changes but must not impose articifial and force changes. The same is true for nature and environment.

Does SC know that what they are asking is not true since independence? by jay on 14 Mar 2008

How SC guarantees protection of local culture and language due to lagre scale migration to a certain city/state within India? I hope SC will admit that we must not allow Chinese style of cultural and linguistic invasion in any part of India (as Chinese do in Tibet). I hope SC knows that what they say is not true for whole India. Still we have many states/localities (J and K, NE states etc) enjoying special privileges. Most of such privileges do prevent those states/areas to integrate into national main stream. We also have special privileges to many people depending on their caste and religion. What about those?

right of Indian to settle anywhere in India by MOHAN DADDIKAR on 14 Mar 2008

I thank the Supreme Court for upholding the right of Indian to settle anywhere in India. Will their lordships confirm that their this decision permits me to settle in Kashmir, an integral part of India as often declared in the parliamen?
