Ex-CM withdraws petition challenging Speaker’s disqualification notice

Chandigarh, March 18 The petition filed by former Chief Minister of Haryana Bhajan Lal along with MLAs Dharampal Malik, Gohana and Rakesh Kamboj from Karnal, challenging the disqualification notices sent by the Haryana Vidhan Sabha Speaker, has been withdrawn by them.

Seeking permission to withdraw the petition, the counsel appearing on their behalf stated the petitioners have decided not to contest the Vidhan Sabha Speaker’s verdict and they would go to the ‘people’s’ court.

The petitioners had demanded striking down the part of the 10th Schedule of the Constitution, especially paragraph six, under which powers have been conferred on the Speaker to decide matters concerning disqualification of members.

The trio had also demanded quashing of two orders passed by the Speaker, dated February 22 and February 29 this year, wherein the Speaker had given the petitioners a last opportunity to file their reply against the notices issued to them.

The petitioners had made the Speaker, Raghbir Singh Kadian and Shadi Lal Batra, Secretary of Congress Legislature Party, as party to the case, apart from the Union of India and the State of Haryana. The petitioners had demanded quashing of proceedings against them that were initiated by Shadi Lal Batra before the Speaker to disqualify them as members of Legislature Assembly.

Terming the notices to be biased, the petitioners had submitted that when their counsels appeared and demanded for four weeks time to file their replies, the Speaker refused the same and provided only one week’s time.
