Washington Offering an unprecedented level of cooperation to Indian authorities probing the Mumbai terror case, the FBI has said it will not seek custody of the perpetrators of the ghastly attacks, which also killed six Americans, and will let India prosecute them.

Under federal laws, FBI, the primary investigative arm of the US Government, needs to investigate and charge sheet and bring the perpetrators to justice whenever an American citizen is killed overseas.

"This is the major tragedy in India, so it is fully appropriate that Indian authorities handle the investigation and prosecution," a FBI spokesperson said.

"If at some point many many years down the road... there is an opportunity for the United States to prosecute them for the killing of Americans, our prosecutors would take a look at that point," he said.

"There is no stature limitation on murders, so it does not matter when that time would be but absolutely the priority here is let India to handle the investigation and prosecution," he said.

At this point of time FBI is not registering a separate case against those responsible for the killing of US citizens in the Nov 26 Mumbai attacks. Instead, it is extending all help to India in investigating the case.

"The FBI will work with the Indian authorities as well as our partners to cover all leads, wherever they may take us," the spokesperson said.

If the FBI means what it says, it should first get custody of the Mumbai attackers and then hand them over to India.

US tries to play neutral by C.K.Sunil on 08 Jan 2009

This is not to assuage the feeling of India. But it is more to help Pak vis a vis accepting their 'assisitancs' to nab taliban from Afgan border. If US is sincere to their statement they can easily get these perpatrators from Pak and handover them to India for prosecution. It is possible that they must have struck a deal with Pak that they will not ask for extradition of these criminals to US as Pak know that if that is done India will have access to the criminals considering the current relation between India

FBI to let India prosecute by k p chandra on 08 Jan 2009

This one appears to be a diplomatic strategy of the US to assuge the feelings of India. But the fact remains that the criminals are at large in Pakistan and are not in custody either in Pakistan or in the US or in India. US FBI should have told the method how to get them first and then who will prosecute them. This is a very weak statement only to pamper India.

US, for what ever be the reason got Saddam of Iraq to be hanged. It is US Power behind the hanging of Saddam. In such case, how much it is to catch the perpetuartors who killed their Citizens. Why we should look US in suspicious for every thing. In the changing world scenario US will definitely want to have good relations with India. and this particular case, is highly sensitive to India and US may be willing to cooperate with us.
