The State Consumer Dispute Redressal Commission has directed Tamil Nadu-based Sri Kaliswari Fireworks to pay the compensation to Gagandeep Singh, who was a 13-year-old at the time of the incident. He had bought the cracker manufactured by the Tamil Nadu unit from Rummy Stores, Sector 44 in Chandigarh.
The child’s uncle G S Bal had stated that on October 23, 1995, the crackers that Gagandeep and he bought for Rs 700 from the Sector 44 store included 10 packets of cock brand crackers manufactured by Sri Kaliswari Fireworks, along with other firecrackers.
According to general practice, neither was any bill issued to them nor did they demand one, stated the complainant.
The same evening, Gagandeep, in the presence of his mother Davinder Kaur and Bal, lit the cracker and retreated by 10 to 15 feet.
The cracker exploded with a loud sound and a splinter ripped through Gagandeep’s left eyelid. Bal stated that he took him to the nearest hospital, City Hospital, Sector-34, Chandigarh where he was given first aid and referred to the PGIMER.
Despite the best efforts of PGI doctors, the condition of Gagandeep’s eye deteriorated, stated the complainant.
He said they approached Professor B R Sharma, a forensic science expert, and sought his opinion. In his report, Sharma stated that the base plug and top plug in the crackers manufactured by the fireworks unit were so hard and tough that it could not be broken with hands and that the crackers did not conform to the Explosives Act, 1884.
