Ahmedabad The Gujarat High Court came down heavily on the Narendra Modi government on Wednesday, criticising it sharply for failing to stop the riots that broke out in 2002.

In a severe indictment of the chief minister, the court said the government had failed and showed negligence in protecting citizens and religious structures.

A division bench of Acting Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala was hearing a public interest litigation moved by the Islamic Relief Committee Gujarat, which sought payment for vandalised religious structures in the state.

The state had opposed this petition, stating it was not its policy, nor was it under any obligation, to repair religious structures that had been damaged in the riots.

The judges slammed this contention, stating the state machinery had completely failed to anticipate communal disturbance at that time, and had subsequently floundered in containing the riots. “The state's inaction resulted in the damage,” the bench held, ordering the government to “repair and rehabilitate” more than 500 damaged places of worship.

The court said when the government had paid compensation for damaged houses and commercial establishments, it should also pay compensation for religious structures.

The high court also put in place a mechanism that will check and report the system of rehabilitation. It asked all claimants to approach all 26 principal district judges across the state in the next two months. The judges have to then clear claims in the next six months. The government has one month to reply to its order, the bench said.

The petitioner’s lawyer Yusuf Muchhala said their 2003 plea mainly relied on three reports of the National Human Rights Commission (NHRC), which stated it was the duty of the government to protect places of worship, and in this instance, the government had failed to do so.

According to the petitioner, there are 294 religious places which were damaged fully or partially during the riots. However, Muchhala said the government has admitted there are around 595 such damaged structures.

Another lawyer M T M Hakim hailed it as a "landmark

judgement" in the country. "This is also probably for the first time that a court has held the state government responsible for inaction and negligence during the 2002 riots," Hakim said.

I am sure no one will deny you the pleasure of building a big and beautiful Ram temple in Ayodhya,however you cannot insist on building it where the Babri Masjid exists. There was a TV program done by Rajdeep Sardesai a few years ago on Ayodhaya , where priests of 52 Ram temples swore that their temple was the birthplace of Ram. Hence ,while I respect your belief ,pushing one's belief on another who does not believe ,doesnt seem right.

today modi is being projected as the next pm of india... not going into the deep details i want to share some basic things. he was the cm at the time of riots,but he failed to perform his basic duty i.e, to protect human lives. commercial places and religious structure. no doubt he brought many mnc to gujarat, changed the face of gujarat, but its not hidden that there has been developmental gaps among communities and areas. some places are given compelete makeover while some ares areas are neglected. given his speeches and planning it is not convincing to logic mind that he failed to stop riots which continued for months... really gold plated

I see a lot of people here complaining about the HC rap. on Narendra Modi govt.Whats wrong with the judgement???? A bench of qualified ppl have made there comments. What is disturbing is the hatred ppl feel for muslims and it is quite evident here and start complaining about what has happ to this community and that. But in reality what they are really saying is we dont like muslims getting there rights in this cntry. As for Godhra train carnage and Kashmiri pandits similiar judgemnts have been passed. And not without milliatary muscle put behind it. If you really want secualrism and peace.HAil this judgment. And call a rotten apple(modi) and rotten apple.

You are correct.let us not treat what happened in Godhra as us v/s them. All are citizens of India.Modi having been brought up by the RSS has a visceral hatred for Muslims/minorities,and this is what caused the pogrom in Gujarat in 2002.

excellent judgement in the history of the country.where was the court when innocent hindus were butchered and continued to be butchered like the Bombay riots and series of bombings in the country. it appears court has always a soft corner towards the muslim community irrespective of their act of riots. Do we want to be a secular country where Majority of the hindus continue to suffer and in the name of minority people of other cast enjoy all the privileges.

What is the status of the investigation of burning of Hindus in the train ? How many from the Muslim mob were brought to justice ? Riots, killings etc are bad, but justice should be applied equally. I say that hang all those Muslim mob who burnt the train and hang the Hindu mob that killed so many innocent trapped in buildings. Lets see if our Muslim brothers agree to this. They may still desperately try to find some reason why the burning of train was somehow not so bad or not so sad. There is always a soft corner in even educated moderate Muslims towards incidents where Muslims are the culprits like Godhra train burning, bomb blasts etc..they still try to find every reason and sympathy on why "poor" Muslim youth who are not "given jobs" resort to terrorism !!! Muslim just want want want and complain complain complain. They cannot obey the law and live like equals. THey always want some more, better, preferable. the forensic report of godhra train burning reads otherwise and even if it is agreed (which is not true)that hindus in train are burnt by muslim mob on the platform (which was not existing)is it justified to burn the innocents in the post godhra riots?if that can be justified why dont the law of these muslims i mean the islamic criminal law be accepted by the same people,which says blood for blood,an eye for an eye.

We should consider what had happened in other parts like Kashmir and Sikh riots,etc.I heard that during Godra some of the political parties so called secular have not condemned that,That means lives of Hindus are not precious, It is too much,Govt should rule this country taking economic basis of people as agenda not as religion.Everyday they are making comments regarding religion and constructing wall between religions,cast,etc

It was Actual Malice in bringing down the dead bodies to Ahmedabad and exhibit in front of media. It was intentional to instigate, ignite and spark riots and cause damage to minotities lives and properties. Further, VHP-BJP had given a bandh call and to make it successful Modi initiated such malin activities. Some development might have taken place in some parts of Gujarat, but it is nothing but his duty as CM. It does not wipe off the effects of Gujarat riots and killing of 2000 innocent people. It is clearly a case of human rights violation. No Gujarati would tolerate this negative, inhuman attitude.

I am tired of reading all the Modi bashing. If he really was the culprit he would not be sitting as CM for this long. We do have a democracy and judiciary. If wishes were truth that is a different matter. India has suffered a lot due to Partition. Ask the displaced hindu's, sikhs from Pakisthan. It is not an easy wound to heal. Gujarath is a border state and many of these people are settled here. They have lots of bad memory of partition. If you want you can check the riots statistic in Gujarath. There were many riots before Godhra. But none after that. Whom do you want to credit the peace? Obviously not Modi.
