Mumbai, March 5: Responding to the show cause notice issued by police asking why the gag order against him should not be extended, MNS chief Raj Thackeray said the restriction infringes on his fundamental right of freedom of expression.

In the five-page written reply submitted by his lawyer Sayaji Nagre to DCP (Operations) Ashutosh Dumbare, Raj said freedom of expression was his fundamental right.

"We have also said there is no prevailing Emergency situation due to which the restrictions must be continued. We have also contested police's claim in the show cause notice which says signature campaign run by the party may cause law and order trouble," Nagre said.

Joint Commissioner of Police (Law and Order) K L Prasad said that based upon the reply, Dumbare may arrive at a decision whether to extend the gag order or not by Thursday.

"This is a quasi judicial process in which the officer concerned decides based upon the written reply and the prevailing situation. I do not have any control over it," he said.

Maharastrians are below average in intelligence by Bhagavan Das on 07 Mar 2008

Low in intelligence, the maharastrians are satisfied with early marriage and a simple life. They cannot compete with others, and so turned on to rowdism to acheive their aims. First it was against South Indians and now against North Indians and already they are fighting among themselves. All major cities should be directly under the central government so that these criminals cannot make money by extorortion

PROHIBITORY ORDERS SHOULD BE EXTENDED TO COVER BAL THACKERAY AND UDDHAV THACKERAY, TOO by HUM HINDUSTANI on 07 Mar 2008

Raj Thackeray and his lawyer before asserting his right to freedom of expression, should get hold of and read 'A Report of the Special Committee on Hate Propaganda (Bill 3-C of the House of Commons of Canada, An Act to Amend the Criminal Code). This report is a study in the power of words to maim and what it is that a civilised society can do about it. Not every abuse of human communication can or should be controlled by the law or custom. But every society from time to time draw lines at the point where the intolerable and impermissible coincide. In a free society, where the privilege of speech can induce ideas that may change the very order itself, there is a bias weighted heavily in favour of the maximum of rhetoric whatever the cost and consequences. But that bias stops this side of injury to the community and to individual members of identifiable groups innocently caught in verbal crossfire that goes beyond legitimate debate and freedom of expression. This report has made great efforts to re-examine, therefore, the parameters of permissible argument in a world more easily persuaded than before because the means of transmission are so persuasive. But ours is a world aware of the perils of falsehoods and hatred disguised as fact and of conspirators eroding the community’s integrity through pretensions that conspiracies from elsewhere now justify verbal assaults. And all in the name of freedom of speech or freedom of expression. Such expressions that lead to violence or threat of violence, murder and mayhem and that which endangers the peace and tranquility of the nation are nothing but criminal acts punishable by various statutes of India.

great thoughts ...but flawed execution. Your kind of comments are as toxic as what Thackrey is spweing. I don't know if you realized this as you typed these words, but you urging the MNS morons to get off the back of north indians only to get on the backs of minority muslims. Atleast when talking about fundamental rights and constitution, have the decency to diffrentiate between hindus and the rest.

Time to wakeup by Rajan on 06 Mar 2008

People of Bihar and UP have to wake up and see what their politicians have done to their state. Nalanda in Bihar was once the center of world education but now it is in ruins. Ordinary citizens have to ask hard questions to their government.-why is it that business don’t come to their states-why there are no pro business policies-why don’t Nitish Kumar and Mayawati go to European and North America countries to attract new businesses? Look at southern sates they aggressively seek investment in their states.-why cant the state government provide basic amenities to its citizens-why does the state government not provide safe environment to its citizens and business-why does the judicial system not work as intended-why is there less education and more violence in schools and colleges

What freedom means?? by VVH on 06 Mar 2008

It is surptising to read that the statement said by Raj saying that freedom of expression is fundamental right which he putting in wrong context. Obviously he does not know what freedom measn. For his knowledge ..." Freedom means one has choice to set ones own limits". Those limits have been set by constitution, laws and regulations. Any expression which hurt innocent and hardworking people is morally wrong.
