Gambhir's one-Test ban upheld, to miss Nagpur Test

Nagpur/Dubai, November 5: The ICC Appeals Commissioner upheld the one-Test ban on Gautam Gambhir ruling the in-form batsman who was not afforded a hearing out of the Nagpur Test in a highly controversial decision that was slammed by BCCI as unacceptable and violating principles of natural justice.

Justice Albie Sachs' decision rejecting Gambhir's appeal against the ban came as a blow to India leaving it without the services of the highly successful batsman with 427 runs in five innings so far in the fourth Test against Australia beginning in Nagpur on Thursday. Tamil Nadu opener Murali Vijay was named Gambhir's replacement for the match.

"Cricket is not a contact sport. Small collisions can lead to big ones... Deliberate collision can never be condoned, however grave the provocation," said Justice Sachs, a senior Judge on the Constitutional Court of South Africa, in a statement from ICC Headquarters in Dubai.

Sachs was given a week's time by the ICC to go into Gambhir's appeal against the ban slapped on him by Match Referee Chris Broad for elbowing Shane Watson during the third Test in New Delhi last week.

Attacking the verdict as unacceptable, the Indian Cricket Board immediately shot off a letter to ICC President David Morgan that the order of the Appeals Commissioner "seems to be pre-decided as the same has been passed without affording the player an opportunity of a personal hearing".

But Sachs said the right to be heard in terms of natural justice does not necessarily imply the right to an oral hearing and that he had already pleaded guilty to the charge of elbowing Watson.

gambhir is guilty and got the just punishment. If there is any arguement it is that his penalty is to lenient. It is his second offence for purposeful body contact in 12months, he is lucky he was not charged with the more serious offence and rubbed out for 4 tests. One question to all those who say he was condemned because of the colour of his skin, if watson had elbowed Gambhir we all know you would be calling for his long term expulsion and burning effigy's of him in the streets, GET OVER IT!!!!. Watsons punishment was close to the mark for a first offence for abusive language, possiblky a slightly higher fine but definately no more. And about this arguement about the instigator receiving the same punishment as the retaliator is nonsense, you recieve the punishment for YOUR actions be it if you choose to instigate or retaliate. And i am pleased to see some indian supporters acknowledge that there cricketers can do wrong, just because they share nationality dont make em right.

Not a single sane Indian will support what you have got to say. Gambhir was provoked by the aussies which has has been acknowleded by one of african origin ICC member UNLIKE CHRIS BOARD. .Watson and others are still living in the era where non whites were harassed and bullied by the white opponents. We are not like the migrants in your country who being refugees ( not that i have anything against them) who cannot speak for themselves and will put up with your shit. Indians. please bring out the worst in you -- full time sledging with maa - bahen . lets have a contest in sledging instead. ALSO THE GAVASKAR/BORDER TROPHY IS OURS TO KEEP.

There is nothing wrong with our skin colour but something wrong with the minds of the ICC board. My advice to the Indian players would be give them back as soon as they say something and give them back with your performance as well. ICC and the aussies have a lot to learn about players from other countries. Well , one eye openeing example is Obama and his landslide victory . Dont hold ur self back or be discouraged becos someone doesn't want you to win the game . GIVE THEM BACK IN ALL WAYS.Since Gambhir is not to be included, take someone like Piyush Chawla or someone who can score .

I think you are racist and of course your aussie players who together with chris boarda and umpire billy get decisions in their favour. This has been going on since a long time . They had problems with Shoihab Akthar for his bowling, also with Sri lankan bowler Murli who was called a chucker and was under scrutiny whenever he played against Australia. In his recent visit to Australis. eggs were thrown at Murli.Watson's vodeo clippage is not being shown where he was seen yelling at vGambhir before he was elbowed.Stop calling us racists. HOW MANY NON WHITE PLAYERS DOES AUSTRALIA HAVE IN ANY SPORTS? if u guys speak about casteism , it is the illiterates and the uneducated masses in India who practice it like the majority of school drop outs in australia . Why do Australians, England, Newzeland get away with it while Asians get caught?We need to learn the art of sledging without Direct Confrontation. Making Comments to seemingly your Teammate but in actual fact addressing the your opposition is approved Sledging from Western Perspectives.They stand in the Slip or close cordon and make Disparaging comments about Opposing Batsmen without Directly addressing them.India, Come On Learn the ART and SMILE at all times.

It over,however decisions always favour the West. Gambhir in the new generation Indian. I hope next time Watson raises his elbow he will remember the pain it could cause. He will still need to face Gambhir in the years to come and be frustrated to get him out. May be he could consider bowling with his mouth next time.

I agreeGambhir should be punished his actions deserve it, but the same quantum of punishment should be given to Watson because without his instigation there would have been no reaction from Gambhir. Also Why was Katich and Jonhson spared, they cleared tried to unsettle the Indian batsman but as usual no action. As usual it seems they are spared because of their skin. The umpires have been spineless when it comes to take action against any whites. Chris Broad has been always considered biased by Indian, but still appointed by ICC. It seems Aussies want Gambhir out of the last test by hook or crook so they can win the last test. Wake up BCCI !!!

over the years we still face racism , guys even in united states , we have a revolution ie. black presedent , but in a sport like cricket still we face clear biased opinions by icc , officials , especially when it comes to australians they tend to ignore even the major misconducts , asians are always soft targets , being the richest boad in the world we still lack in exercising our rights. shameful!!! , its gambhir today it might be whole indian team next time . please somebody tell them.

What Gambhir did is wrong and he needs to be reprimanded. We may not like the quantum of punishment specially when it is compared with the lighter one meted out to Watson. However, BCCI should not make it a big issue and focus away from the game, which is already suffering from lower spectator interest. Gambhir is young and he needs to learn and go ahead. His frustrations should needs to be channelised into his batting. Let the bat do the talking.
