"The police approached the girl with a woman activist and counselor but she refused to cooperate. She has also refused medical examination," a senior police official said.
The 14-year-old German was allegedly raped by 21-year-old Rohit, who has been missing from his residence at Taleigo and Miramar in Panaji since Tuesday.
Police have already booked a case against him under Goa Children's act and various sections of Indian Penal Code (IPC) for rape and sending lewd SMSes to the minor girl.
Advocate Aires Rodrigues, counsel for German researcher Fadela Fuch, who lodged the complaint on October 2, said that girl's refusal for medical examination or deposition before the police does not hamper the case.
"Goa Children's Act is very stringent. The onus lies on Rohit to prove that he is innocent and not on the girl that Rohit is guilty," Rodrigues said.
"Rohit has consistently sent SMSes to the girl. It is for him to justify for them," he added.
Rodrigues, who is a legal advisor and a social activist, is recuperating in the hospital after he was attacked by a gang of masked hooligans on Monday night.
The lawyer, however, said that the girl's deposition is important to make the case more strong as every part of evidence is vital.
"The mother is facing trauma as she has been pressurised by some people to withdraw the case. The child is scared. This is a very sensitive issue," Rodrigues said.
The lawyer has demanded that senior lady police officer should be made in charge of the case.
Rodrigues talking to the media from his hospital bed on Wednesday afternoon, however, demanded that the police should be allowed to inquire impartially into the entire episode.
"There should be no political interference," he said.
The lawyer also stated that Goa Chief minister Digamber Kamath had called him up to inquire about the health and assured him saying that ‘law will take its own course.’

Open your eyes ..did u not read abt the rape cases in Bombay...in Delhi..n god knows how many more all over the country? The Indian culture where a girl can be wearing the baggiest jeans and a plain old top and yet be leched at my disgusting men and it is accepted? Whatever formalities the Goa police is observing in the "German Rape Case" are just an eyewash. The absconding son of Goa Education minister will ultimately be declared a good an ethical person, however stringent the the "Goa Children's Act" may be. The Act is meant for the common man and not the heavy weights, the so called "royalty". Education Minister Atanasio Monseratte should relax as the administration is on his side. Only precaution the Hon'ble Minister should take is that his son should remain underground till the case and its memory is erased from human memory. Then the father and son would be labelled as respectable and moral citizens of India.

The fact remains that there are hundreds, possibly thousands of innocents languishing in jails for the simple reason that no one will believe them - BECAUSE THEY ARE MALES. For all her rantings and ravings and hysterical feminine qualities, I have to admit she has me stumped on the fact that this German girl probably gave consent while she was only 14 to have sex with this young high society man. So we are all to take it that this man has to be jailed for accepting her consent, and be charged with the utterly unjust crime of RAPE?

The only pitiful thing here is how heartless a person you seem to be..using suffering to justify suffering? Have you been privy to all talks within Christian communities and people to know if they're fighting for justice in this case or not? You're taking a crime like this and trying to generate communal tension. No better than the people who are responsible for the brutalities in Orissa it would seem.Lots of Hindu and Muslim men commit rapes everyday..most are never dealt with by an hindu/muslim communities. No matter even if the police have registered a case against the erring offender of the state's minister, eventually it will all fizzle out and the memory will trickle into oblivion. For such is the power of the politicians and the rich in Goa. What happened to Scarlet's case? Nothing will happen. Everything will be hushed up by threats, violence and money. All including the victim will be quietened. Nobody will be able to do any thing. The only way out is to attack such offenders and bring them to mob justice. This is the only way in a place or society where the appointed keepers of law in the state act either as lords or puppets. I feel disgust in stating this, but have woken up to the reality of our system. Most of us the biggest hypocrites in the world.

The girl now refusing to undergo a medical test would actually hurt her cause. I do sympethisize with the girl but the rules have to be applied in equality if this case has to reach a conclusive end. Lets hope not that this issue is being forcefully covered up or alternatively, a case of blackmail.
The girl needs to cooperate for examination to prove the fact. Whatever may be the outcome it should be fair trial and not a case of blackmail by the victim's family. Sending incorrect SMS can be dealt with separately but punishing someone with a hard stick for something else that he did not commit would definitely be wrong. The judgement should not be biased because it is the case of a foreigner. The law is same for everyone.

Goa before 1961 was more hostile towards anyone else who was not christian. I also do not see any western or Asian country treat Indian victim fairly. Go to nay other country and see how they treat our victims. We are still treating them better than thye treat us. I certainly do not favouring criminals, but system in other country generally do nto pay attention on victim if they are from India.
