The Left parties, however, insisted that there was no consensus on the deal and warned the government of serious consequences if steps were taken to operationalise it.
Making a suo moto statement in the Lok Sabha, External Affairs Minister Pranab Mukherjee defended the initiative, saying it was essential to ensure end to an "unfair technology denial" regime and sanctions faced by India for over three decades.
"We will continue to seek broad political consensus within the country to take forward our engagement on this issue with other countries," Mukherjee said.
He did not elaborate but was clearly referring to efforts to overcome the stiff opposition by the Left allies to operationalisation of the deal with the US.
Seeking to allay the apprehensions of Left and other arties over the Hyde Act, Mukherjee said the legislation was an enabling provision between the Executive and Legislative organs of the US and India will have civil nuclear cooperation with the US under the 123 Agreement only.
"India's rights and obligations regarding the civil nuclear cooperation with the US arise only from the bilateral 123 agreement agreed upon with the US," he said.

Hats off to the right-thinking Indians/NRIs who contribute here and warn about the perils of this nuclear deal as it stands today. It is easy to be misled by the politicians at one end and well-meaning people on the other due to their aspirations to progress at any cost. The reality is that the deal is only beneficial to the US and that is why so many US official come knocking. China has explicitly made in its similar agreement with the US that internal acts do not apply, but India does not have such a clause. It is a simple legal principle that the provisions of the ‘enabling’ legislation will prevail if the agreement or its provisions based on that legislation prove to contradict any part of the legislation. Whatever one puts in the 123 agreement with India is just an eye-wash because at the end of the day because the Hyde Act was enacted to eliminate and wind-back India’s nuclear capability. The US has never concealed its intentions and has been open in all its deliberations. Likewise, the USA was honest with its objectives of giving teeth to IAEA for inspections that are more intrusive, tightening the NPT regime and translating this fresh momentum on disarmament into stricter technology controls. So the net effect for India is no ‘technology’ transfer but perpetual dependence on the US or other NSG for its energy security. US can terminate the agreement at any time on many grounds including India’s failure to report its storage of fissile material including Thorium, that’s right folks, including Thorium, capable of putting a cap on its indigenous three stage program. If this is not absolute slavery, what is it ? The UPA’s intent is suspect. Either they are incompetent or untrustworthy.

Why is the Congress-UPA so obstinately hiding the Hyde effect? After Pokhran 1998, there were doubts about its yields and the success of the fusion device, underlining the need for further testing. Has the Congress-UPA decided that, Hyde Act or not, there's no risk at all of a US ban on our further nuclear testing simply because we are just not going to do another test for the 40 years of the Agreement's life? Has it decided to let our nuclear weapons programme become atrophied? Has it also decided to be, as VP Singh fears, a vassal of the USA? We, the people of India, need to be told the truth... now.
Impact of Hyde Act on the 123 agreement: US Secretary of State Condoleezza Rice clearly said, 'we will support nothing with India in the NSG that is in contradiction to the Hyde Act. It will have to be completely consistent with the Hyde Act. Rice's statement was the "consistent position of the US administration regarding the applicability of the Hyde Act".
Once you study the n-deal in detail, you will not support. Many young Indians support the deal out of ignorance, ignorance born out of neo-richness. When majority in parliament rejected the deal, why Congress want to impose the deal on the nation? Surely, there is hidden agenda of Congress. Congress with 145 MPs, out of 545 MPs, behaving as they had mandate to rule the nation like dictators. Congress had no guts to make our nation as n-weapon state. But now they want to de-nuclearise us. Friends, think wisely; and not run after emotions.

Some specific constraints of USA's Hyde Act on the India-US nuclear deal: 'Under the 2006 Act, Congress retains considerable control over nuclear exports to India. Thus, Section 104(e) requires that a 123 Agreement made by the President with India has to be approved by a joint resolution of the two Houses of Congress (unlike Agreements with other states). Section 104(f) allows Congress to terminate an Agreement by a joint resolution of the two Houses of Congress. By Section 106, an Agreement will automatically terminate if India explodes a nuclear device.' There are many more serious constraints on India.
Interesting comments by Mr Meher and Buddha. I think Meher is right in that if the government wants to go ahead it should have the guts to do so. I would like to remind how BJP went ahead with the nuclear test and how the world fell in line with India after all the threats and debates. I see very sinister motives of the Left. If hyde act apply to Nuclear supply group and USA insist for it than India should not operationalize the 123 agreement, as Americans have said in past that Hyde act. is internal matter.
