The sources said it was very unlikely that the Centre would act on the recommendation. Plans to appoint a new CEC from within the present EC after Gopalaswami’s retirement on April 20 remain unchanged, they said. Navin Chawla is expected to succeed the CEC.
The Congress, which said it was studying the issue, on Sunday indicated its resolve to back Chawla all the way.
AICC spokesman Abhishek Manu Singhvi also pointed out that Gopalaswami had been handpicked by the then Home Minister L K Advani to be Home Secretary before his appointment to the EC, and that there appeared to be a “remarkable congruence” between his views and the BJP’s.
Government sources maintain that Gopalaswami had, by informing the Supreme Court that he had the authority to decide on fellow ECs and by sending an unsolicited view to the President asking for Chawla to be removed, departed from what his predecessor B B Tandon had told the Court in June 2006.
Tandon had said the CEC cannot act suo motu on the memorandum before him unless the President first made a reference to the Commission.
They are also of the view that the proviso for the possible removal of an Election Commissioner requiring the nod from the CEC, is meant as protection for the —Cżto guard against a possible arbitrary government move to tamper with the functioning of a Commissioner, and not the vesting of the right to sack a colleague in the hands of the CEC.
The allegations against Chawla essentially centre on his alleged proximity, and partisanship towards the ruling Congress party.
Asked if the Congress would continue to back Chawla to be the next CEC despite the current political controversy and its potential to soil the authority of the Election Commission, Singhvi told The Indian Express on Sunday: “Despite all uncertainties and chaos, which the BJP has tried to create, let me assure you that India’s constitution and institutions are robust. Everything shall proceed in the same clockwork manner as it was designed despite repeated attempt to derail it and to create chaos before the election, which is clearly the BJP’s object.”
Singhvi said it was for the Government to decide on the complaint against Chawla. “As for the credibility of the institution suffering, those responsible for it will have to be asked,” he added.
“We have not ever commented on a constitutional authority, but are compelled to do so now only in responseżWe could but we never did assail the fact that Adavani had picked him (Gopalaswami) up as his Home Secretary at the Centre before he was appointed EC. We could similarly have pointed out the case of Himachal Pradesh where election was pre-poned by four months without even consulting the Chief Minister, which was unprecedented,” Singhvi said.
The spokesman described the “timing and sequence” of the CEC’s recommendation as “peculiar”.
“From 2005 to 2007, there is no whisper from the CEC about any of his colleagues. In the Supreme Court, the BJP fails to elicit any order despite clamouring for it. Suddenly, while the matter is pending in the SC, the CEC, on his own, states that he has the power to make recommendations on his colleagues. On that magical statement, the BJP immediately withdraws the petition and transfers the complaint to the CEC. Again from 2007 to 2009, the CEC is silent and does what he does on the eve of elections. This remarkable congruence of views between the BJP and the CEC is the most unfortunate,” Singhvi said.

"Government unlikely to act on CEC note" - Did we expect Congress to act when they have not done so for he past 60 years on matters that call for transparency, probity, good governance. Is Congress party, under Sonia, determined to destroy the moral fibre of every institution in India? It is not about BJP vs. Congress as made out by the media. The decay is much deeper. The Congress party, obsessed with the continued hegemony of Nehru Gandhi family (for various compulsions), has systematically and unashamedly eroded the integrity of almost every constitutional pillar in the country. We can look into their past record (including emergency period) of policy decisions, legislations and ordnances and constitutional amendments. There is a pattern that smacks of covert dictatorship, hidden agendas and creating sectarian divisions.

Dear Sir, I infact hail from Kashmir. Despite having lived there and have taken participation in almost 6 Elections. I never beleived that Elections were rigged there ever. But, now, I am sure that the Election might had been rigged in the past. Otherwise, why should Govt. or any political party disagree with the authority who has some doubt about the integrity of one of his subordinates. This speaks volumes of dishonesty and misinterpretation of Laws. The Laws and Rules are framed for the good of Nation not to create disharmony or doubts about its interpretations.The "Honest Authorities" should immediately act to modify the Constitution to the extent of interpretation and applicability of Laws. There should not be any ambiguities. Hope think tanks will react , advice and suggest proper implimentation of Rules and Regulation, besides, Laws.
There is nothing surprising in govt's decision not to act against Chawla. Why should they? After all, didnt Sonia personally instruct Chawla's induction into EC, shrewdly calculating that such a move in 2005 would ensure that 2009 elections are fought by congress with the former in the CEC chair? So they will go all out to see that their original plan works. One thing Sonia has learnt beautifully from Indira Gandhi is how to have beaucrats loyal to the family holding key constitutional posts. In this case, both the constitutional posts (President and CEC) are manned by individuals fiercely loyal to Gandhi family. In comparison, BJP made Abdul Kalam President. They made honest Gopalaswamy CEC who has listed 16 instances of Chawla's bias towards Congress. Country has a right to know which are those 16 instances. It is hardly Gopalaswamy's problem if his dim opinion of Navin Chawla matches that of the BJP. Chawla was a notorious character of emergency days. He should never be CEC.

From what figures and facts appear from the press and the electonic media, the allegation of bias in respect of Mr Chawla dates back to 2006; If as per the constitutional provisions, EC can be removed based on the recommendations of CEC, as a layman I am amazed by stands taken by the political parties. If the suo motto report is the issue which is seen as not in proper line, then he can his study and make recommendations only if the allegation against any ECare forwarded by the PMO. If this will not happen because the bias shown is towards the rulilng party, never will the allegation be forwarded by the PMO. Then what for is the constitutional provisions of recommendations of CEC?As a layman again I feel the CEC's recmommendations should be sent to Supreme Court .
The supreme court is the only hope now in blocking controversial Chawla from becoming the next CEC.I think Mr.S.Y.Qureshi should be appointed as CEC not Chawla under the circumstance.
that chawla is a corrupt official and that he was hand picked by sonia gandhi for his loyalty towards her family was pointed by the media at the times of his selection. It is not view, the CEC has presented the same with evidence. somebody shd ask the powers that be as to why an indicted officer was selected in the first place. sonia has corrupted the EC also. as long as genuflection is followed in the INC, these things will happen. I wish every one reads the Gurumurthy's column in IE on the subject published in IE. The appt of sawla is wrong right from the beginning. To make him the CEC is unimaginable! India will with the help of CEC become a banana republic with sonia as president and Rahul asPM! The media will as usual will be more subseviant than today!
Poor CEC. You are still immature for this country. You should honour the spirit of a BIKAU COUNTRY headed by a BIKAU party. The current ruling party is well known to honour only those who can fetch votes and pay lip service to its italian lady or gandhi family. Look at Antulays, mulayams, lalus, sorens, shekhar guptas, navin chawlas, patils and so on so forth. Everything else, however best suited for country, is meaningless e.g., Kalams, Bachchans, vajpayees, savarkars, etc.
Next only to Judiciary people had great faith in the election Commission, particularly after Seshan storm. Now with the recent unfortunate episode in the Election Commission pointing to fissures, people will begin to wonder regarding the tragic drama being played by high echelon constitutional authorities. with due respect to the constitution. rivers have crocodiles. whether it is congress or bjp. only on the day when the president of india is directly elected by the people of india, we can expect unbiased; unprejudiced constitutional authorites, in the real sense. let us strive to uphold the constitution.
When I imagine The virus of congress corrupting the office of EC, it really sends chill in my spine.
The congress is full of corrupt people and the indian express is supporting it to the best possible extent now that Shekhar Gupta of the Indian Express has been given Padma Vibhushan. This is just outrageous and needs to be condemned in the strongest possible words. The CEC has aparently demanded the removel of Chawla as he is pro congress having received funds form the congress party in the past. This aspect has been completely hidden by the indian express from its readers. The IE needs to highlight the main reason for which BJP and the CEC are opposing Chawla. Instead the IE is trying to inform its readers what the cngress is saying about the CEC. This is gutter journalism. Such mediamen should be stripped naked on the city square and flogged. They are the enemies of the country.
This is a classical case which should be referred to the Supreme Court to decide within 4 weeks. This is unprecidented that the CEC recommends an action against a fellow commissioner. We want to have the impartial EC. Who is right? Is CEC right or Mr Chawla right? This needs to be settled by the SC, not by BJP or Congress parties. My view is that 204 MPs could not be that foolish to raise concerns about someone who is a great election commissioner. BJP went to SC against Mr Chawla. There must be some serious concerns against Mr Chawla. We want our elections to be held in a fair and unbiased manner. "Chawla issue" must be decided ASAP.
What if any political party, say BJP also refuse to accede to the recommendations of the EC, say about 'model code of conduct' during elections and cite Congress/UPA decision as precednt and claim that they would do what they want?UPA/Cpngress is denigrating and destroying one of the main offices/pillars of Indian democracy -- the independennt Election commission.The countrymen would realise to their regret that this is very dangerous precedent.But, it may be too late by then!But then, who cares?Remember Seshan?What if NDA ahd insulted him and had refused to act on his advice?
It is sad and most misfortune that the goverment decides to support Navin Chawla when he is asuspect.
The recommendation by the Chief Election Commissioner for the removal of Navin Chawla on the ground of partisanship just a few months before elections is rather surprising.The move is going to raise many eyebrows and spark a controversy as the CEC himself is superannuating in April 2009.Clearly moving from the Supreme Court's judgment in T.N.Sheshan,Chief Election Commissioner of India vs Union of India[1995] and taking a whole year in passing the adverse remarks has raised suspicion about the motive with which the CEC has made such a move and a commitment or promise made to the CEC for taking such a step cannot be ruled out.
