“At this stage, in view of the material gathered, there is prima facie sufficient material to frame charge against J P Sharma, the former deputy director of CWC in 1998-1999, and other accused persons,” said Additional Sessions Judge I K Kochhar.
The court ordered framing of charges against them under provisions of the Prevention of Corruption Act and Indian Penal Code.
Other accused are Y P Sharma, Dominic Dung Dung, Natha Ram Suman, Chandreshwar Manjhi and S K Aggarwal.
According to the CBI, Sharma had conspired with the help of the other accused to withdraw eight cheques in the name of his family members and receive medical reimbursements worth Rs 1.99 lakh by depositing forged medical certificates and cash receipts of AIIMS.
One accused helped Sharma clear the fake bills despite glaring discrepancies in them, said the investigating agency. Sharma contended during the hearing on charges that since there were two chargesheets filed in the case, he was liable to be discharged whereas the other accused claimed that they had just acted in accordance with their official roles in bona fide manner. The court, however, said that at this stage, the evidence was sufficient to frame charges against the accused and they could put forth their defence when the trial starts.
