According to the police, she had attacked one of the assailants — 55-year-old Vijay Kumar Sood — with a knife, wounding him seriously. She was sent to 14 days’ judicial custody. But in the court of Additional Sessions Judge Sanjeev Kumar Agarwal, the public prosecutor failed to establish a motive behind the alleged attempt to murder. The judge agreed to the plea for bail, directing the prosecution to collect evidence in support of its claim.
Davinder N Grover, counsel for Shah, said: “We have pointed out from the beginning that a charge of attempt to murder does not hold any water in this case, especially since there was no motive. The alleged victims came to Soni’s work place and abused her.”
Shah herself had maintained that the stabbing was an accident. “I do not know how the sharp object came into my hands. I just reacted in self-defence... five persons were beating me and tearing my clothes... I never intended to wound anyone seriously.”
At the time of her arrest, Shah had alleged that she was threatened, thrashed and abused by the men. “They told me they will strip and parade me naked in the market,” she had said. Her clothes were torn and face was bruised at the time of arrest, but the Gurgaon police had failed to register a counter FIR based on Shah’s statement. Shah’s family and counsel had been trying for long to register a complaint.
