59-year-old Saeed, who has been under house arrest since December 11, was ordered to be released immediately by the High Court which held his detention as illegal.
India voiced its disappointment over Saeed's release, saying it raises serious doubts over Pakistan's sincerity in acting with determination against terrorist groups and individuals operating from its territory.
"These actions by Pakistan raise questions about sincerity of Pakistan's investigations into the conspiracy that planned, launched and executed the terrorist attack on Mumbai," the External Affairs Ministry spokesman said in Delhi.
JuD is Pakistan-based terror outfit Lashkar-e-Toiba's front organisation.
A close aide of 59-year-old Saeed, Col (retd) Nazir Mohammad, also held in connection with the November 26 attacks in Mumbai, was freed alongwith Saeed by the High Court.
In a brief order, a three-member bench of the High Court said, "The court accepts the petition of Hafiz Mohammad Saeed and Col (retd) Nazir Ahmed against their detention, which is illegal. The court orders their immediate release." A detailed order will be pronounced later.
JuD activists, who gathered at the court, began shouting slogans in support of Saeed following the order. A JuD spokesman hailed the verdict and said the organisation will continue its "relief activities".
Saeed, also founder of the LeT, was put under house arrest on December 11 last year after the UN Security Council banned JUD, declaring it a front for Lashkar-e-Taiba, which is blamed by India for the Mumbai attacks that left 160 people dead.
JuD chief's counsel A K Dogar contended that there was no evidence of Saeed's involvement and that his detention violated Pakistan's constitution and laws.
Striking a defiant note, Saeed vowed to continue his struggle against what he described as the "India occupation" of J and K.
Denying any involvement of JuD in the Mumbai attacks, Saeed told a press conference held at a mosque in his hometown that his detention was a "conspiracy" against Pakistan.
Dogar, who shouted slogans like 'Allah-o-Akbar' (God is great) along with Saeed's supporters after emerging from the court, said the JuD chief had been detained on December 11 last year without any valid grounds. During an earlier hearing of Saeed's petition, Pakistan had for the first time admitted that JuD had links with al-Qaeda.
The judges said the government "has no sufficient grounds to detain the petitioners for preventive measures". They added that the government could not rely on the UN Security Council resolution, which imposed restrictions on the JuD, to detain as two men as this was "not desired" by the resolution.
The bench quashed the "impugned detention orders" for Saeed and Ahmed and ordered that they should be "released forthwith if not required in any other case".
The government of Punjab province said it would appeal against the High Court's order in the Supreme Court. Provincial Home Secretary Nadeem Hasan Asif said the government was consulting legal experts about filing a review petition in the apex court.
Official sources said the appeal would be filed within the next few days.
The High Court issued its order after hearing arguments by the JuD chief's counsel A K Dogar, who claimed the detention of the two men violated Pakistan's constitution and laws.
Dogar said the UN Security Council had only sought a freeze on the JuD's assets and a travel ban on its leaders and the world body had not demanded the arrest of JuD leaders.
He claimed it was not binding under Pakistani laws to implement UN Security Council resolutions.
The Deputy Attorney General of the federal government and the Advocate General of Punjab province rebutted Dogar's arguments.
The Advocate General said it was binding on Pakistan to implement Security Council resolutions as the country was a signatory to the UN Charter.
Saeed's house was declared a sub-jail during his detention. "We will provide security to Saeed if we are asked by our high-ups," said SSP (Operations) Shafiq Ahmed. During an earlier hearing of Saeed's petition challenging his detention, Pakistan's Attorney General Latif Khosa had told the High Court that the government had evidence which showed the JuD's "prima facie links" with Al Qaida.
This was the first time that Pakistan acknowledged the JuD's links with Al-Qaida. Saeed and Ahmed had challenged their detention through a petition in the High Court. Saeed and several other JuD leaders were placed under house arrest in the wake of the Mumbai terrorist attacks but most of them were subsequently freed.
Five LeT activists, including Zakiur Rehman Lakhvi and Zarar Shah, are currently being tried by an anti-terrorism court in Rawalpindi for alleged involvement in the Mumbai attacks.

Our Constitution stipulates that India is a secular country.Each ctizen has a duty towards his fellow citizens to ensure that his or her religious activities do not affect the basic secular structure of our Constitution.The fedral Government and the State Governments must practice zero tolerance level against all religious practices which tend to damage the said basic structure of our Constitution.Unfotunately,the vote bank politics has given a sence of insecurity to both, majority and minority communities of our country.Hindus are in majority.Pakistan has done his best to destabalise India by propagating that muslims in our Country are not safe.The election of 2009 has proved that vote bank politics is no more a relevant factor for the people of our Country.Youth of our country dose not want to think on religious lines.BJP needs to think about the poor of this Country.Hindus do not need a political name.Secular India will always win.BJP needs to realise grassroot realities.

Again, spineless cowards of UPA express their disappointment, frustration, anguish, unhappiness etc etc and then go to US and other western countries and cry before them and plead with them to take action against Pak and then go home and sleep with their wife peacefully, claiming that they applied both domestic and international pressure on Pak to rein terrorist and terrorism. They also claim unashamedly that people of country voted for congress for applying diplomatic pressure to curb terrorism on Pak soil. What else can we expect from slaves of a Roman Catholic woman?
Normality for Pakis who are anti-India so be prepared for more 26/11s and don't just keep talking do something constructive for the citizens and nation.

Things would get worse with the UPA in power because it has succeeded in dividing the nation and getting elected. UPA's main strategy is to woo the minorities and the various castes and it defeated NDA's minority bashing. So, do not expect any thing better from our politicians.

Pakis always win the diplomatic war against India because, like a failed and jealous neighbour, they are overly focused to destabilize India. Obviously, in their 60 years of existence they have gained nothing to lose anything anyway. But the Babus in our establishment are always on the defensive because they are inapt to provide safeguards to the people who elect them. They are good at rhetoric, promises and begging for our votes but so timid in their actions. All they can do is issue a “Chetawani” and a “Kari Chetawani”. Unless and until their own lives are in danger and attacked, they wont really wake up. This is what made them almost attack the Pakis after the Parliament attack few years ago. The 26/11 chapter is almost dead. The Pakis have done it again by engaging our Babus in mail back and forth. Our Babus are more than willing to type letter after letter anyway. This makes them look busy. God Bless India!
It was known fact that Pakistanis are not serious about 26/11. We want to know if Indian government is serious about 26/11 or will keep on begging to Pakistan for justice. Pakistan is not fooling us but it is our politicians who are fooling the nation on this issue. Why we have not taken any steps against pakistan rather than askling them for Justice? If Chiddu is unhappy, it is because he is fooling himself and the nation. What you can expect from pakistan other than lip service but our politicians are also doing the same instead of taking some strong steps against pakistan. Are we going to wake up from deep slumber?

Indian have got a very good government who will save them. I feel Indian voters are happy with congress. Anti-terrorism does not fetch votes, nationalism does not fetch votes. Caste and religion gets you votes that is why Congress, Mulayam and Mayawati get votes in India. This illiterate country will never change.

Clearly Pakistanis feels that with their offensive in the Swat Valley they are now again in the list of good guy with the americans and now can revert to their standard pattern as far as behaviour with India is concerned (support terrorist, meddle in Kashmir and and and). We would like to know whether the Home Minister is going to just leave it at being disappointed or does think of taking any tangible actions? I thought the blasts and happenings in SWAT and Lahore would have opened the eyes of the judiciary of Lahore but it seems it has threatened them. A day may not be far off when all those who helped the Mumbai offenders go scot free, would themselves be targets. Pakistan is having enough of Terrorists attacks and still Sense has not prevailed on them. We should be extra vigilant on our borders and ensure not a single Pakistani/Other Terrorist crosses over to India. This alone will reduce terrorists incidents in Kashmir and other border areas.
