"The BCCI was firm on its stance that racism charges levelled against Harbhajan should be totally dropped. Had the charges stuck, they would have reflected badly on the BCCI and the nation at large," said, V R Manohar, BCCI-appointed lawyer for the off-spinner, here after the conclusion of the appeals hearing in Adelaide.
"He (Harbhajan) admitted to have hurled abuses (of non-racial nature) against the first aggressor Andrew Symonds.
Once the level of the Code of Conduct charges was reduced from 3.3 to 2.8, it was left to Justice (John) Hansen to hand out appropriate punishment for the offence under which he now stood charged.
"It varied between the higher end - a ban of two ODIs and one Test - and 50 per cent of the match fees. Since he had not been charged since 1998 (Under the CoC) the lowest level of punishment was meted out which worked out to 50 per cent of match fees," Manohar explained.
Manohar defended Harbhajan via a teleconference while seated in the BCCI headquarters here when the hearing was held in Adelaide.
"Statements were taken from Sachin Tendulkar and Harbhajan from the Indian side while the Australian side was represented by Symonds, captain Ricky Ponting, Matthew Hayden and Michael Clarke," he added.
Manohar also said that the past undercurrent of tension between the two teams and especially between Harbhajan and Symonds in the aftermath of the World Cup (Twenty20 event in South Africa where India beat Australia on way to clinching the crown) was also taken into consideration while handing out the punishment.
"It was Symonds who was the first aggressor and Harbhajan retorted. That was also taken into consideration at the hearing," said the father of BCCI's president-elect Shashank Manohar.
"It was also explained that Harbhajan knew Symonds only as an Australian player and nothing more about his race or religion," Manohar added.

WHAT A SHAME FOR INDIANS!Y ACCEPT FINE WHEN ASSIES R ALLOWED CALL INDIANS BASTARDS.BEND UR HEAD IN SHAME.BCCI IS MOST SHAMELESS AGENCY,CORRUPT.
What should ICC do about racist and biased South African judge Mike Procter? How to make Sydney test null and void and this series result should be 1-1? Power and decision making of ICC is controlled by white people, this must change.
At last years Mumbai ODI, I witnessed huge parts of the crowd chanting 'Aussies suck' amongst other things, sticking their middle fingers up and swearing their heads off at the Australian cricketers. Many of these 'fans' left the game early in Indias innings when they thought India may lose, they missed the fightback and really weren't there to watch cricket. Leaving aside any monkey business; racist chants and gestures continued even after the match was won. Do all Indians behave like that? Only an ignorant fool would think so, just as only an ignorant fool would think that of all Australians or any countries populace.
a very good judgement and justice is given.the bcci has given its full support to bhajji which saved him
Microphone record opens the door. Hayden was suggestive that "racial overtones" can be exploited :Hayden says "that's racial villification"and Clarke supported it. We need to be more concerned about BCCI selling IPL to one of the Ozzie's. What sorts of things they will do and what sorts of things with these Indian Industrialist and Actors do with IPL. Copying ICL is not always a good solution for BCCI.
BCCI and the Indian team have been manipulated by the Australians and the ICC into a compromising situation. It was utterly foolish and immature to drop charges, voluntarily or otherwise against the Australian spin bowler.Australians are a roothless bunch of hoods and they need to be dealt with using Australian methods. BCCI should have kept the leverage of twisting the arm of the Australian bowler, if they were to push Harbhajan in a corner.Australians are the most uncivilised, vulgar, unsportsmanly, arrogant and racist team.Let us forget now the Gandhian stance and deal two blows for one blow. Crude methods and barbaric behaviour is the only currency that we can consider when dealing with the Aussies. Ian Botham has the correct idea about the Australians and has put in words very clearly.
