High Court stays evacuation of flat after resident fails to pay EMI

Kolkata, June 23 The Calcutta High Court has restrained Birla Home Finance Limited from taking possession of a flat, which was bought by one Sandipa Mitra, after the latter failed to pay the last 12 installments.

While hearing a petition filed by Mitra, Justice Dipankar Dutta today issued a stay order on the evacuation notice served by the finance firm.

Mitra had purchased a flat on Chetla Road in Alipore after she availed Rs 2-lakh loan from the firm around eight years ago.

She started repaying the loan and has already paid 66 monthly installments, each amounting to Rs 2,579. Till date, she has paid Rs 1,70,214 but for the last one year, she was unable to pay the installments owing to financial problems. Following this, the company sent her a letter saying that it would take possession of the flat. This led her to file a petition in the court.

Appearing on behalf of Mitra, advocate Biswadeb Choudhury today argued that the company should have served her a notice in accordance with the existing rules and regulations.

Instead of issuing such a notice, it had written a letter to Mitra saying that it would take possession of the flat. Mitra had been living there for the last six years with her daughter.

JEEB directed to file affidavit by July 17
The Calcutta High Court today directed the Joint Entrance Examination Board (JEEB) to file an affidavit by July 7 stating why answer scripts of students could not be produced before the court.

The direction came after a petition filed by a student, Rajdip Das, came up for hearing before the court.

The petitioner had alleged that his answer script had not been evaluated properly. Das in his petition said that he had secured A+ grade in his higher secondary examination, but could not get a rank in JEE 2008.

JEEB counsel Subrata Mukhopadhyay cited a recent order of the Supreme Court that prohibits answer scripts of any competitive examination to be handed over to students.

He argued that JEE is a competitive examination therefore the answer scripts could not be produced before the bench or handed over to Das.

Earlier, three students who had appeared in the JEE had also filed a writ petition alleging that their answer scripts were not properly evaluated.

The matter will again come up for hearing in the court in the last week of July.
