26-year-old Jafarkhan Palayangara did not understand the deal he had struck with the sex worker in Swindon because of his poor grasp of English, a local media report said, adding he attacked the woman because he was not happy with the services she had provided him and wanted his money back.

The incident led to a fracas in Swindon’s red light area following which the Indian ended up charged with attempted rape, it said.

After considering his side of the story, prosecutors at Swindon’s crown court accepted his plea to common assault and dropped the more serious charge of attempted rape, according to ‘swindon Advertiser’.

Passing the sentence, Judge Douglas Field said: “... I have decided that the proper way of dealing with you (the defendant) is by way of a conditional discharge for 12 months.

That means that if you keep out of trouble for the next 12 months you won’t hear any more about this offence.” Colin Meeke, prosecuting, said the decision was based on Palayngara’s “lack of understanding and poor English” and the “nature of the occupation’ of the victim”, the report said.

“There was a dispute over the nature of the services she was to provide, he having handed over his money. There was clearly some sexual congress not what he wanted, not what he expected, not what he thought he had paid for.

“He wanted his money back and there was a struggle. That struggle became vigorous.... He was fairly quickly arrested,” Meeke was quoted as saying.
