New Delhi Amidst the raging debate on the powers of the proposed Lokpal, Tamil Nadu Chief Minister J Jayalalithaa today said the Prime Minister must be kept out of the purview of the anti-corruption body because “frivolous or politically motivated” complaints could erode the authority and credibility of the high office.

“I think the Prime Minister should be excluded from the purview of the Lokpal because of the following reason: The Prime Minister is already covered under the Prevention of Corruption Act. Any misconduct by the PM can be investigated by the CBI.

“Secondly, the Lokpal can be used by foreign powers to destabilise the government. When a frivolous and politically motivated complaint against the PM is referred before the Lokpal and if the same is telecast by the TV channels, which run it round the clock, it will dent the PM’s credibility and authority. Even if nothing comes out of it (allegations), it will seriously dent the authority of PM,” Jayalalithaa said in an interview to Times Now.

Jayalalithaa is the third chief minister to speak against giving the Lokpal powers to investigate the Prime Minister. Her remarks are completely in tune with the Centre’s own opinion on the matter.

Delhi Chief Minister Sheila Dikshit and Punjab Chief Minister Parkash Singh Badal have earlier expressed similar views. Dikshit went to the extent of saying that there is no need for a Lokpal; existing mechanisms can be strengthened to deal with corruption.

Civil society representatives, who forced the government to set up a joint committee to draft the provisions of the Lokpal Bill, are strongly in favour of bringing the Prime Minister within the ambit of the Lokpal.

Jayalalithaa said her intention was to protect the high office of the Prime Minister and not any individual occupying that post.

“Very often we have seen that when someone becomes the Prime Minister, immediately there are a whole lot of people who try to pull him down. We have to guard the high office against such tendencies,” she said.

Tamil Nadu is yet to give its opinion to the Centre on the Lokpal legislation. “The state’s view can be formulated only after the final draft Lokpal bill is presented in Parliament,” Jayalalithaa said.

Jayalalithaa also echoed the central government’s views on exempting the CBI from the Right to Information Act. Secrecy is essential in certain matters, she said.

“There are certain areas in government where secrecy has to be maintained. The CBI deals with hardcore criminals and terrorists. If every bit of information sought to be obtained is given, how do you then deal with criminals? Certain amount of secrecy is must,” she said.

On the movements led by Anna Hazare and Baba Ramdev, Jayalalithaa said there was nothing wrong in social activism, but it must not seek to create a “parallel government”. She said the midnight forceful eviction of Baba Ramdev by Delhi Police earlier this month was “totally uncalled for” and “unnecessary”.

“It could have been handled with much more tact and in a better manner. It could actually have been ignored,” she said.

Who above Lokpal by Yashwant Kamlapurkar on 28 Jun 2011

Now the point remains. Who is to be placed above the Lokpal so that the person functions within the boundaries of justice & morality. Say there should be Supreme Lokpal to give the eyes down to the Lokpal. And somebody other than M/s Anna , Ramdev & Co. had better lap up the lascivious chunk of common man's sympathy that has recently come up for takes.

Jaya echoes Centre, says PM can’t be under Lokpal by DR Rana on 28 Jun 2011

Till such time the CBI is an independent body governed by an Act solely meant for it (it should not governed under the Police Act at at present but by a separate Act), the PM must not be excluded. Even otherwise the present PM could not get himself elected by the People in the elections as MO but a back door entry through Rajya Sabha, so he does not hold mandate of people to be PM of India. Also, as required by Constitution he is not a leader of the party in power.

Jayalalitha by Shirish on 28 Jun 2011

It is not at all surprising. By asking that the PM should be out of Lokapl, she knows she can extend it further to apply the same to the post of CM- preferably with retrospective effect- so that she can be out of perview for ever!! What with so many corruption charges against her??!!

who is she by Srikumar Menon on 28 Jun 2011

Politicians And Lokpal. by Nirvikar on 28 Jun 2011

Now a days People contest elections to earn money, which comes through wrong channels. As such almost all politicians will come under the scanner of Lokpal or Lokayukta. It is a common sense that how one will accept a system change which will not only stop their earnings but also will punish them. Accept BJP most of the supremos of state level parties are the out sprung of Congress Party. Hence, a public movement like Egypt can force the present govt. to bring a tough LOKPAL BILL.

Jaya echoes centre,Says,PM can't be under Lokpal by SAMIR KUMAR KANJILAL on 28 Jun 2011

It is the political leaders who are responsible for this situation. Why the question of bringing PM in the purview of lokpal bill has come ,because the behavior of the politicians has raised the doubt about that chair also.Hence instead of giving lip service politicians should look at their own inside and act accordingly. No lokpal will be required.

JAYA ECHOES CENTRE SAYS PM CAN NOT BE UNDER LOKAPAL by A.J.VAIDYANATHAN on 28 Jun 2011

C M Jayalalitha can be fanciful to the extent of telling the nation to-morrow that country's PM may also be stooge of foreign players. She sometimes has impractical views and she should inculcate democratic values in her own Party.

Lokpal and Indian democracy. by kamalgaur on 28 Jun 2011

Before Mamata, and now Jaya singing the same tone as they are congress chief ministers. These women are not good for Indian democracy. Now they are in power and going to compromise on issues of National Importance. People of their respective states has voted them in power because they were fed-up withe corruption of previous regime, now people will be felt cheated, if these women compromise on corruption from top.

Why have law? Let's do what pleases us by Nkautlya on 28 Jun 2011

If you want to have one law for the political/babu/judicary class and other for commoners, then why have criminal and anti-corruption law? We can very well do as we like . I have query, why is govt not taking action against corrupt; Why is govt not taking measures to crub hostile attitude by our neighboring countries? I think the pololitical class has been feed by the Pakistan/China or by big fat corrupt lords.
