New Delhi The Delhi High Court observed on Tuesday that judges should not be treated like MPs, MLAs and other representatives of the people on the issue of asset declaration since such information about them may be misused.

"Public interest standard for the judiciary has to be different from other institutions. So judges have to be treated differently from people's representative on the issue (pertaining to declaration of assets)," Justice S Ravindra Bhat said.

He was responding to an RTI applicant who had contended that that Judges, like MPs and MLAs, should declare their assets.

The court said that judiciary should be liberated from all kinds of fear and personal information of judges might be misused if divulged under Right to Information Act.

"Judges have to work according to law and without fear. For the proper functioning of judiciary it has to be liberated from all kinds of fear. Election Commission and other such institutions are vibrant because they are independent," Justice Bhat observed.

The RTI applicant who had sought information on judges assets, however, said that revealing of such information would not affect transparency and independence of judicial system.

judges above law by ajay bansal on 24 Mar 2009

Seem like judges do not want to be covered under any law, and want to make money for themselve as and when they like. lawyers too think they are above the law. so it mean law is left only to harras common people. as justice is blind, so it is unable to see judges taking bribes and making tons of money.

Our of all the spheres of Indian polity, justice delivery is the most backword. One reason is that it has remained hidden from public scrutiny for long. Time has come to bring some transparency to the system now. Judges must be made to declare their assets.

why judges be spared by mukesh sharma on 24 Mar 2009

why judges be spared. they r working under the same constitotion like others they r under legal or moral obligation to declare their assets. Why a honest man a judge or anyone else are relucatnant no to declare their assets publiclly. It is unfortunate that judges who teach the govt officals n slammed the govt for corruption as a daily routine during the hearing of matters, r making a law virtualy non-applicable for themselvaes.
