“The court said that since it was an interlocutory order (order granted before the trial ends as opposed to a final order sealing the matter), the revision is not maintainable. Therefore it was dismissed,” said Chief Public Prosecutor R V Kini.
When asked if he would challenge this order in the Bombay High Court, Kini said, “There is no point in challenging this order. We will get the same order.”
The 14 accused in the Juhu molestation case on New Year’s Eve were granted bail on a surety of Rs 10,000 each by an Andheri metropolitan magistrate on January 4 on the ground that they were charged with bailable offences. The accused were charged with unlawful assembly, wrongful restraint, outraging a woman’s modesty, causing hurt and various other offences under the Indian Penal Code and the Bombay Police Act.
The accused, however, were in judicial custody for four days as the police took time to verify their sureties.
Deputy Chief Minister R R Patil had said that the state would challenge the bail to the accused.
Around 1.45 am on the New Year’s Day, two young couples leaving the J W Marriott were caught in a mob. The two women were molested for close to 10 minutes until photographers at the spot alerted a passing traffic police van. The police registered a case only 24 hours later.
