The Governor's sanction came despite the CPI(M)-led LDF government's recommendation not to give permission to prosecute Vijayan, holding that there was not enough evidence against the Marxist leader.
The Government had made its recommendation based on the legal opinion of state Advocate General that there was no evidence to prosecute Vijayan, but CBI has stuck to its position that there were enough grounds to proceed against him.
CBI Additional Superintendent of Police Premkumar received the letter from Governor, giving sanction to prosecute Vijayan, the Central agency sources here said.
The case pertained to alleged corruption and irregularities in awarding contract for renovation of three hydro electric projects -- Panniyanr, Chenkulam and Pallivasal -- to Canadian firm SNC Lavalin when Vijayan was Power Minister in 1998.
The CBI, which probed the case, had found irregularities in awarding the contract and wanted to arraign Vijayan as ninth accused in the case.
The agency had also stated that the contract had resulted in huge loss to the state exchequer.
CPI(M) had all along took a position that the case was politically motivated.

Chief Minister V.S. Actually he should have laughed now with out fear. Because he put forward his opinion to give sanction for prosecution and fight the case in the court. If Pinarai Vijayan is innocent why did he and his party worry? Let the government go ahead with prosecution procedures and let him come out with ordeal by fire. Congratulations to Governor RS Gavi for sanctioning CBi to process corruption case against Pinarayi Vijayan. In India politicians feel they can do anything and escape. Pinarayi Vijayan was playing a game with his words for accusing most of the people who love democracy. He was the main cause of the defeat of all CPI candidate in loksabha elections, making no way for a candidate to contest for RSP, Janatha Dal and making him a hitler. Remember, he asked Veliyam Bhargan to go out of the CPIM office at TVM. He accused NSS, Christian community and kissed the feet of Madani,once a terrorist and Vijayan alloted a special room in CPIM headquarters in TVM pushing other parties as well as the chief Minister VS Achuthanandan to a corner. Without even knowing what is engineering, he delivered a good speach in the engineering hall. But the content was to accuse his coworkers, other LDF alliance and the press.Who is he? to accuse the press. What he knows about Syndicate?He hoped to become a Lenin after election, but became a grass after the election. EVen after that he accused others to make his supremacy. He derves a big punishement and to be put in jail.
Hary Nambiar is closing his eyes against facts. Yes, the governor reserves the powers to supersede cabinet decision; so is the President of India. But that powers are exercised very rarely and here that is done by Shri Gavai, which cannot questioned. Bringing in Bofors and Black money issues are irrelevant here. The issue boiling here is, how a one time Minister, now heading the communists in Kerala, did a misappropriation of 630 cr. Where has the money gone? How much was given to the Central Leadership, which makes the PB and central committee to stand rock behind Vijayan. The lion share was given to CPM central leadership and that is why Vijayan is bold enough to say, ask the PB. Achuthanandan who had no role in the matter is playing his role impartially, which is perfect. So, Nambiar talk of Vijayan's crime not Governor's constitutional right.

Whether CBI or judicial commission, no culprit is ever going to be prosecuted in our country. Come elections and these will serve as cannon fodder for the opposition. Ministry' denial of the permission did definitely smelt rat.
If the folly committed by Prabhakarn using human shields as a barricade is any pointer Pinarayi Vijayan too is to commit the same folly. Of course the SriLankan incident has certain patriotic flavor but Vijayan's case is that of morality in public life.Observing Black Day or instigating followers for narrow political mileage has already taken its toll as is evident from the just concluded elections.The party will ultimately end up as a bunch of tainted leaders with no support base given the fact that the self-projected image of V S as a champion against corruption gets good support from the grassroots level already if the surprise win of the two candidates from Palakkad is any pointer where V S has the strongest base.The Communist movement has given Kerala enough impetus to emerge as a forerunner state thanks mainly to the erstwhile leaders of the likes of AKG and Krishna Pillai who spent a lifetime organizing the underprivileged and working class.
All politicians live at the cost of all citizens who vote for them in the belief that their area and finally the nation will be benefited with their welfare activities. Now it has become a greatest profession having no business ethics to loot the country. Since the power corrupts and absolute power makes them absolute corrupt. So they keep sticking to power knowing well that all cases against them will be one day cleared through political manipulations.
If Mr.Vijayan were innocent why should he fear prosecution? After all the judicial trial will only clear his name or if proved guilty mete out fitting punishment. In a democratic society like ours the suspect has to be tried and cleared or punished. The invesitgating agency will not arbitrarily bring anyone before the law. Only when it suspects sombebody it makes serious investigation and if found sufficinet evidence frames charges. So it is most appropriate that Mr vijayan goes before the judiciary without claiming immunity or finding lame excuses. He is only a citizen like any other citizen. Party secretary is not beyond or above the law of the country. It is not North Korea or Cuba or is it?
I believe that it is up to the CBI to prove that it has a case. If the trial process proves that the evidence is insuffiant then it is the reputation of the CBI that is at stake and heads must rool at that agency.Law enforcement agencies must have a free hand to persue their cases to their completion.They must take into account the reputation of the people they are prosecuting and as such must ensure that they have a sound case.They should not even be required to seek approval from any other authority. I hope this is the begining of things to come.
If Vijayan is innocent of the charges he would have nothing to worry about, would he? Only the guilty try to use loopholes to stall investigations. More power to the governor and CBI. These corrupt politicians such as Vijayan should be hanged in public.
In our country (UK), Scotland Yard, Metropolitan Police or for that matter, any police force don't need Queen, PM, or any minister's approval. So does the FBI in America. Tese things doesn't happens in civilised democracies. So, what does it say about India ?

Is the Governor an agent of the central government? Does the Governor have powers to supersede the State government decision? Probably the Attorney General’s recommendations might be wrong, but when the Cabinet accepts it how could the Governor disregard it? Why did the governor not refer the matter to the State Legislator? Of course there seem to be scope for an investigation against the alleged team. However, is the Lavelin case the only one? Why the central government does not properly investigate the Bofor scandal? Why does the central government not investigate the complaint by Dr. Subramaniam Swamy and the other complaint by Shri Ram Jethmalani and others and the case involving the hidden black money of 1.7 trillion dollars in Swiss Banks?
Very good His Excellency Governor has kept the reputation of the constitution of India and democracy. Let him prove himself in the court if he is not running a political mafia and have a clean hand...
The sanction to prosecute Pinarayi Vijayan in the SNC Lavalin graft case ought to have been granted much earlier. The CPI(M) ought to have taken the initiative and voluntarily persuaded the government to do so, so that it would have become a worth emulating model in Kerala politics. Parties are accuountable to the public. Wherever graft is alleged, parties must volunteer to subject themselves to investigation and public scrutiny. Such readiness will pave the way for the public to have a better faith in politicians and for corruption to come down drastically. The CPI (M) lost a golden opportunity to cleanse the state politics.
Though the officials of the party may not agree but,the Governor has done a great service to the communists.If Pinarayi was left scot free he would have made sure that the CPIM became an endangered species in Kerala.He has led party to become a mafia organisation and shamelesly protected the interests of rich people,ignoring the poor workers who had voted his party to power.I hope the party take this as a boon and work for the benefit of common man and win back their confidence in the party.

Justice prevailed !!! People of Kerala have been waiting since long to book this culprit, who pocketed 630 cr. from the state exchequer. This was the major reason why CPM lost in Kerala. The corruption free CM, Achuthanandan deserves to be congratulated for the impartial attitude on the subject. Vijayan must resign forthwith; so is Prakash Karat, who shielded Vijayan all along.
