Lawyer’s conclusion: Govt’s conspiracy

AHMEDABAD, DECEMBER 17 Concluding his PowerPoint presentation before the Justice Nanavati-Justice Shah Commission on Saturday, Jan Sangharsh Manch advocate Mukul Sinha tried to prove that the burning of the S-6 coach of Sabarmati Express was not a “pre-planned conspiracy” as alleged by the prosecution.

He submitted that the fire in the coach was result of a “flash-fire phenomena” as till today there has not been any evidence to establish the conspiracy theory. “Primarily, we tried to prove that the conspiracy theory projected by the state government is completely baseless and there has been no evidence to establish the same. Even kar sevaks have not stated that the train was set on fire by somebody who entered the coach from outside,” Sinha told mediapersons after the hearing.

Sinha also challenged the government line that 60 litres of petrol was used to set the coach on fire. He submitted that had petrol or any inflammable fuel been used, there would not have been smoke in the coach for 15 minutes as the coach would have caught fire instantly.

‘’Had petrol been used, the coach would have caught fire immediately but this was not the case,’’ he submitted, adding that 60 litres of petrol would have gutted the entire train.

In his presentation, he also challenged that the train was stopped by a second chain-pulling. “There is no evidence to show that there was a second chain-pulling done by Muslims in the train. However, it remains on record that the first chain-pulling was done by kar sevaks travelling in the train,” he said.

He also submitted that had the kar sevaks not pulled the chain to pick up their left out colleagues from Godhra station, the train would have passed through the station and the incident would not have occured.

He also submitted that there was an inordinate delay on the part of the fire brigade to reach the site. “Had the fire brigade personnel reached immediately after the fire, many lives would have been saved,” he added.

On Chief Minister Narendra Modi’s visit to Godhra after the incident, Sinha submitted that why the CM was allowed to enter the S-6 coach when even the panchnama had not been made. He also challenged the VHP theory that Muslims had conspired to burn down the entire train. He submitted that the Chaneval village is 12 km-14 km away from Godhra towards Dahod and the Sabarmati Express had no halt there.

“Could the VHP disclose how the conspirators were planning to stop the train at night when no one was permitted to even board the train,” he asked, suggesting that the theory had no foundation. He also pointed out glaring contradictions in the chargesheet filed on the Godhra incident and the confessional statements extracted from the accused.
