Let boys and girls marry at 18, says law panel

New Delhi, February 6: Suggesting radical changes, the Law Commission has proposed reducing the minimum age of marriage for men from 21 to 18 years and declaring unions below the age of 16 as void.

"The age of marriage for both boys and girls should be 18 as there is no scientific reason why this should be different," the Commission headed by A R Lakshmanan said in its report.

The suggestion by the Commission for declaring marriages below the age of 16 as void is something which has not been recommended in the statutes.

It has also pressed for compulsory registration of marriages and recommended that men, just like women, should be allowed to wed at 18 and children below that age barred.

In its 44-page report presented today to the Law and Justice Minister H R Bhardwaj, the Commission has also proposed that the age for sexual consent should be raised from 15 years to 16 years for all girls, regardless of marriage.

If accepted by the government, consensual sex with girls under 16 years of age could invite punishment meant for rape.

A man's sex with their minor ‘wives’, aged below 16 years, could also become punishable. Under the existing laws, having sex with a minor ‘wife’ above 15 years is not rape.

Besides recommending compulsory registration of marriage, the Commission has proposed that marriages involving children between the age of 16 and 18 be made voidable (which can be annuled with mutual agreement between both the parties on attaining adulthood).

While studying the Prohibition of Child Marriage Act, 2006 (PCMA), the Commission found that the present law did not make a child marriage invalid even if it was below the age of 15 years. But under the criminal law, section 375 of IPC makes it a crime to have a sexual relation with a child under the age of 15 years.

It's plain nonsense. Considering the general population, at 18, a guy barely completes his standard 12th exam. Unless he inherites riches from his father or forefather, it will not be possible for him to earn a living. Why govt is so keen to allow such guys to get married. Rather govt shoudl focus on reducing unemployment and proving quality education.

in my sense of view it is the right path taken by the govt. as in the todays era the girl and boys both become sensible at the age of 16-18 though their is no any objection as they both are ready to marry.

i do not agree with this decision as 18 is very early.i think that the age should be increased to 20 for both boys and girls. that way girls will get the oppurtunity to study atleast till 20

18 is such a young age; and what difference would it make if marrying at 16 if the legal limit is 18. 2 years of maturity in indian society when the guy hasnt even finished school decently? sounds ridiculous to me. marriageable age should be atleast after the 21 because the the guys would atleast be in a position to finish college degree. otherwise we will end like the western society.... lots a kids with no identifiable parents.

If it can apply to all corners of India it is a good move and hopefully the parliament would make it a law soon. Sure,if applied without fear and favor, it will root out the child marriage status in India.Those parents who dare to break the law should be dealt with severely. However, the problem in future would be to get anyone married at all! Financial independence for both boys and girls would bring a phenomenon of narcissism in the personal level,as we see in the western countries.Essentially, it means none of them would want to get married and take responsibly of bringing up children and feel 'trapped' in a relationship. This is good decision for everyone. It will stop AIDS, diseases and people will learn more from mistakes, at young age. Expect more Divorce RATE as 18 age is more of immature age for guys, not for girls. Best marrage is MAN-21-24 and Girls-18-20.
