Local CPM leader alleges illegal detention by CBI

Kolkata, March 26 Badal Garu Das, a local CPM leader in Nandigram, currently in CBI custody, has alleged that he has been illegally detained by the investigating agency.

The CBI had taken Badal into remand from the CID on March 11 for his alleged involvement in a rape case in Nandigram. Arpan Chatterjee, Haldia ACJM has directed the CBI to produce Badal on April 7.

Meanwhile, the CBI told Haldia ACJM that Badal Garu Das was currently in Tihar Jail, following court orders. Badal is also wanted for involvement in various other criminal cases lodged at the Nandigram police station.

The CID had arrested Badal from Nandigram on March 9, for his alleged involvement in various criminal cases, including a gang rape case. The CBI reportedly took him into remand on March 11.

The CBI was asked to produce him on March 15 at the court.

Meanwhile, the CBI took the accused to Delhi for recording his statements under Section 164 of CrPC and was unable to produce him in court.

Netai Das had lodged a complaint with the Nandigram police station on March 19, last year alleging that Badal and his accomplices had raped his wife Kabita Rani Das on March 15, 2007. Das alleged that the group raped his wife, as the family had refused to join a CPI(M) rally.

Advocate Soumendra Ghosh, CBI counsel said that Badal was in jail following the order passed by the magistrate at Patiala courts on March 17.

Meanwhile, Advocate Swapan Adhikary, counsel of Badal said that the CBI was asked to produce him in court today. He added since the agency failed to do so, it was a violation of the court order.

Adhikary also moved a petition alleging that the CBI detained Badal illegally. The CBI had taken up the FIR (47/2007-Nandigram PS), while launching investigations in the case in November 2007, following an order passed by the Calcutta High Court.
