Identifying the MLA as Yash Pal Kundal, a party release in Jammu said that he in defiance of the party whip voted for the ruling coalition as he faced threat to his life. Pointing out that an inquiry into the matter was conducted by a senior party leader Bansi Lal Sharma, the release said that the MLA apologised for his action. However, a final decision into the matter will be taken by the party's working committee, it added.

Earlier Panthers Party had issued a whip to all its three MLAs that should vote in favour of PDP in the Rajya Sabha elections. Panthers Party said that the party had taken a decision that its MLAs should give a first preference vote to PDP candidate and the second preference vote to the BJP candidate.

The party said that the decision asking its members to vote in favour of the opposition candidates was to defeat the ruling coalition candidate. However, while the two MLAs voted for PDP candidate, one voted for the ruling coalition.
