"What's the difference between North Indians and Indians. All of us are Indians," a Bench of Justices B N Aggrawal and G S Singhvi quipped, while posting for Monday, a PIL seeking judicial inquiry into the killing of a Bihari youth Rahul Raj in a police encounter and the murder of another North Indian in Mumbai last month.
On Tuesday the apex court had observed that if there was a ‘political will’ such hate campaign would not occur in the country. It had also cited Article 355 to drive home the point that the Union Government had adequate powers to give necessary directions to the State to prevent such incidents.
The Bench of Justices Aggrawal and Singhvi said it would hear the matter along with another related PIL which had earlier sought appropriate directions to the Government to ensure that the country's unity was not threatened by vested interests fomenting regional chauvinism.
Incidentally, the apex court had directed the petitioners in both cases to suitably amend their petition and come before it when the matter is taken up for further hearing.
During the brief arguments on Thursday, the petitioner Sanjeev Kumar Singh submitted that he was compelled to approach the Supreme Court as the authorities in Maharashtra had failed to respond to his request for providing adequate protection to North Indians in the state.

There is a certain amount of marginalization every linguistic minority in India feels when faced with Hindi chauvinism. The faster the Hindi-speaking people learn to recognize this the better. If you remember, before we got independence, learning Hindi was considered a part of the freedom struggle and the Dakshin Bharat Hindi Prachar Sabha flourished in Tamil Nadu. The same people opposed Hindi later on. Ever wondered why? Cultural hegemony, denying other languages and cultures a place in the sun, these do not make for a great country. I am a Malayali in Gujarat. I spoke in broken Gujarati, respected their beliefs (not the religious intolerance) and I got love and affection there, even though I was a secular man in a highly intolerant state. I speak in broken Marathi, even worse Marwadi.. I feel India is richer for all this diversity and we should encourage it. This does not, however justify MNS, but MNS starts its business from these same premises, giving it the right twists.
It is constitutional right of "Bhashavar Prant" Mr. Raj Thakre is fighting for self and Marathi peoples. It is constitutional ACT protected by Mr. R.R.Patil(Aaba) .It is state head Mr. Vilasrao is protecting for Marathi peoples then why outsiders are using abusive language against them. This is insult to state of Maharashtra. By insulting state peoples of this mindset have no right to stay in maharshtra may be he is sanjay nirupam or krupashankar. They can not use devide north indians and rule Mharashtra. If they have really good adminisrative capability they should go back to their home and clean dirty state politics. Maharashtrians will come for help! And then many multinationals will land in their state like Gujrath. Seperating out Marathi peoples from railway recruitment they can not win over Marathi's- Andurlekar
Local V/s OutsidersAs per constitutional divide of the state done at the time of framing constitution all have agreed that state administration will perform as per regional language. The parliment, Supreme court, has not changed this frame till date. This means that Marathi peoples of Maharashtra have definitely constitutional right to have age over any other language speaking citizens of India. If this is the case what is wrong if Mr. Raj Thakre is asking for constitutional right of Marathi speaking public. He is fighting for his own right and right of other Marathi public. Then why north Indians Bangalis and other peoples are using abusive language to Mr. Raj Thakre. This type of abusive language is used all ove Bihar, UP and perticularly in delhi. No one in delhi comes to rescue of others in case of calamities to unknown peoples. In Mumbai also no one except Marathi peoples comes out for help. somehow i do not agree with Jatin. Regional politics are being played in Bihar-UP as well as in MAH. I agree that Marathi Manas is not poking nose in other regional politics. But that does not mean doing so is wrong. If MNS is so Maharastiotic than don't you think they should start by throwing out Gujarati's first. Just because Gujaratis are fattoos and they pay ransom, Raj won't say a word against them. On the contrary he won't let a working class people to appear in Railway Test if he doesn't happen to be Marathi. I respect will of Marathi People. And i am sure Raj won't get any support from them. This is great to know abt this Maratha culture to allow migrants(Parasis/Gujaratis/Biharis/Bengalis/UP etc) to develope their city and when the tree is bearing the fruit - start kicking those who nurtured the tree so that one can have all the fruits. Migrants should take lessons from this and ask their own land leaders for similar kind of developments from their leaders(someone can communicate this to Mr. Nitish Kumar and Ms Mayawati).Also, these states ban goods(agriculture/non-agriculture) from Maharashtra. Let them be reliable on their own resources. Need is the mother of invention. Let Jharkhand/Bihar ask Tata why they have their head quarter in Mumbai when they get almost all the resources from Jharkhand?? Why Mumbai to be benefitted from Jharkhand resources?(But why not MNS asking Tatas to go back to Jharkhand?) Let such acts continue till supporters of MNS wakeup to their tiny and temporary gains. The founders of Indian Constitution has granted us a right called ‘Right to freedom’ which elaborates that an Indian Citizen has the legal right to ‘To reside and settle in any part of the territory of India’. As the adage goes “Every dog is the king of his lane”, we understand the emotions of original Mumbaikars. But why do you forget the fact that, lot of non-mumbaikars has toiled from dawn to dusk to build up today’s Mumbai.Brothers! Let’s stand united as Indians and try building a peaceful India for our little ones.
I wonder what the SC is trying to tell. Why is that SC is unable to dictate terms with MNS chief to say that MNS actions are in violation of the constitution of India and that MNS chief should be hanged for killing innocent people and damaging public property. Gutless SC and gutless political parties like congress.
Unfortunately the the strength of India is not known to Indians. That is why much of us support the zero mind personalities like Bal Thackerey and Raj Thackerey. When will be understand that a Muslim is also an Indian and North Indian is also an Indian and Bramhin is also an Indian and other caste guy is also an Indian. the SC should also act against the likes of Mayawati, Laloo, Nitish Kumar, Karunanidhi, etc. who have also been in forefront of fanning regionalism. We all are Indians? Does it mean we all should speak only Hindi? Does it mean people can go to better places and ruin those places? Does it mean Marathis should not get fair chance to get central government jobs?
Unless we realise that Bharat's survival is fundamentally dependent on Unity in Diversity, we will all perish. Intra-country migrants must respect, learn and acclamatise with local language and culture without sacrificing their own. Similarly, the locals must not bully migrants who acclamatise. North-Indian hegemony on other states is evident. Remember Bharat is not just Hindi and North-India. Yesterday it was Tamil Nadu, today it is Maharashtra, tomorrow it will be Karnataka. Bangalore is already feeling the heat from the Bhaiyya culture and their disdain for locals. All Dakshin Bharatiyas are stereo typed as "Madraasi". Kannada is scoffed at in Bangalore. Our local culture is scoffed at.If each state is bullied like this, then naturally the locals will rebel and thus our Bharat will die. Beware fellow Bharatiyas, let us respect local culture and foster brotherhood. Not hegemony. We all are children of Bharat Maata. Please, let us remember Unity in Diversity. Vande Maataram
this has been a real craze to call this action of raj as appropriate. india dows not belong to a bunch of people who want to save theri political asses. this is my country! and noone has the right to use it for climbing to the seats in the politics of this country. MNS is using the people's emotions to become a figure in this country.Biharis should be checked, but it does not mean they can be thrown out with force. there can be some other solution for sure, but MNS wants it loud and that the solution will be silent. Hi, I am not really all against raj thankrey and other fello marathi's. I am for preserving the local culture but I think there are some misconceptions.1) Maharastra and Mumabi in particular is not developed by only maharastrianns and it is not because of your abale leadership that your state is developed. If you see all states who are on the costal line gets developed because buisness makes sense there, e.g Maharastra, Gujrat, Hydrabad and Now Tamilnaidu. So you have geogrophical advantage over other other, your politicians are as bad as other states. You have got developed into a state because others have worked there, so it is not correct to say outsiders should not come to Mumbai. If you would have had the same policy long times back you would have been another UP or Bihar. So when jobs are generated locals have a mjority share but others also benfit from it. I do not see most of the outsiders occupying jobs in Maharastra.Also voilence is not right way to correct things.
I think every state must have a development plan. It is the will of the pople to see this happen. It is time to question and demand leaders and place them in to accountability. Every thing can be decided by the ballot box. Education and Industry are the prime reason fo a state to be developed. If these are not taken care of by the repective state leaders, it is a shame. Today Mumbai is the bread basket for all Indains. This must stop. It is time to spread out the development in to other areas of the state. This will help migration control.
Many States hardly saw any development all these years. Some cities/places/States developed better than other places because of certain socio-politico-geographic advantages. Due to lack of development, migration started and is still continuing to metropolitan cities to get some sort of livelihood or the other. Too much of it overburdens the cities and local people get deprived of opportunities. It is natural that they react and sometimes violently. Wherever we are, it is important to integrate into the local community and culture. We should not be a burden but an asset to where we live. To avoid future problems all State governments should make each State self-reliant at least in another twenty years. The governments should also develop more major ports like Mumbai all along the vast coast which will reduce the burden on metropolitan cities. Otherwise the already overburdened metropolitan cities will explode.
Its shameful that every now and then the honourable Supreme court has to intervene and tell the legislature what are its duties
Though I do not agree with MNS in all its claims against north Indians, the apex court should have recognised why this anger against North Indians is on the raise. Why Maharastrians are feeling this way? If the MNS is becoming popular because of this why? There is also a Hindi Chauvenism which takes other linguistic minority speaking people for granted. For example some grievances in terms of job and other issues need to be heard. There are considerable number of issues with linguistic people which are not Hindi which needs to be addressed seriously. Somehow there is also a feeing that local people's jobs are taken away by outsiders - particularly majority people from Hindi belt. The same kind of feeling exist among the other regions as well. If this is true then one has to address imbalance if it is not true then one must try to remove such ignorance among diverse communities.
If we are all same why do we have reservation and quota based system. Why article 370 and special privileges to the people of a state. We are never united and we can never be united. Even before British Raj we were seperae identities and we are still the same. Nothing has changed. To worsen the situation the language based division has further vitiated the atmosphere.

This is what MNS whats. We are spiting venoms on each other for being Biharis, Marathis, Bengalis, Punjabis and so on. This is a typical political ploy. Alienate a group from others, instill fear in them so they only vote for you. Imagine what will happen if every state adopted the same approach, we will be 25-30 different countries then I guess we all will be able to protect our language, culture and traditions pretty well.
Supreme Court's observation that we are all Indians and have every right to live and work wherever one likes is a ringing reassertion of what our Constitution guarantees to every citizen of India. According to Article 355 of the Constitution, 'It shall be the duty of the Union to protect every state against external aggression and internal disturbance and to ensure that the government of every state is carried on in accordance with the provisions of this Constitution.' Given this provision the state of Maharashtra must move with full force to rein in the sponsors of the "Son of the soil" theory. If it doesn't the Centre must intervene. No patriotic Indian can afford to see our hard-won freedom being eclipsed and India disintegrating.
Cultural and ethenic diversity makes India so beautiful place on earth. Omce you cross border of each state everything including language, food, clothes everything change which makes it so attractive. Dont try to homoginise India like USA. In USA once you have seen a major city there is nothing much to visit. Same language, food, clothes, big roads and same restaurants from East to West and North to South. The try to attract tourists with artificial creations like Disney world in Florida. Please respect local cultures and traditions and preserve them stedfastly. Do not homoginise India.
Marathis are free to create their own companies and wealth and give 100% reservation to Marathis.But if wealth is created by government then everyone should have shares as everyone contributes. No 100% reservation for Marathis in this case please.Every Indians should be free to speak his own language of choice and Marathis should not be imposed.
