MP law: 7 yrs in jail for eating beef, cops can raid on mere suspicion

Milind Ghatwai

Posted: Jan 03, 2012 at 0238 hrs IST
Cow slaughter is now a serious offence and could invite a jail term of up to seven years in Madhya Pradesh.

Bhopal Cow slaughter is now a serious offence and could invite a jail term of up to seven years in Madhya Pradesh. Consuming, keeping or transporting beef of any cow progeny will invite the same punishment. A police official not below the rank of a head constable — or any person authorised by a competent authority — has the power to enter, inspect and search any premises “where he has reason to believe that an offence (under this Act) has been, is being or is likely to be committed and take necessary action’’.

These stringent provisions will be notified after the Madhya Pradesh Gau-Vansh Vadh Pratishedh (Sanshodhan) Bill, 2010 received the President’s assent on December 22.

Citing public interest and communal harmony, the BJP government argued that existing legislation provided for only a three-year jail term for cow slaughter and had several flaws. The state government amended it in July 2010 and sent it to the President. The new provisions will enable authorities to punish transporters, their employees and drivers with jail terms from six months to three years.

The Centre felt that raiding premises merely on the assumption that an offence is “likely” could be misused and recommended that such power be limited to cases when an offence had taken place or was taking place. The amended legislation has disregarded the recommendation.

BEEF BAN by R Kumar on 26 May 2012

Why can't we have a complete total ban on any kind of cow meat trade (including export of living cows for meat)in entire India with extremely stiff mandatory punishment.

why only cow? by mr william on 18 Feb 2012

Why only cow? why not chicken, pork, goat, sheeps are they not get eaten by we human being??? ... this law will create communal dispute & its against the nature & will be against the food chain & food web.. ecology will dis balance. Its racial against other communities in India

anti beef by suhas on 18 Apr 2012

as india is a secular country we must respect each and every community so consuption of beef and pork should be banned...

Religion not the same as Hinduism by Anand on 24 Jan 2012

Religion is not the same as Hinduism. The Vedic scriptures and all the above references are largely Hindu in nature. Various animals are sacred in various religions and it is not too fair that only cow slaughter is banned. Being a Hindu majority nation is not reason enough. If it were Brahmin dominated somebody would have tried banning non-vegetarianism. People do not like somebody else view being enforced on them and it is not good to enforce your views on somebody else is something even a 3 year old knows. Apparently for political gain some of us like to forget that. Also as a matter of fact only in one particular religion are cows equated to mothers, please do not take it as a fact that everyone agrees to (we live in a secular nation, i thought). It is just a shame that people here who claim to be educated do not want a tolerant nation where everybody is free to practice their own religion in their own homes.

Wonderful decision...Congratulations! by Dr VrindaBaxi on 15 Jan 2012

Criticism of Government's decision is mere foolishness, especially in this regard. It has right to interfere with people's eating habits etc simply because it is ideally meant to be responsible for people's welfare and even 'karma'. It should similarly also discourage people from smoking, drinking wine etc. Only these kind of measures will help in ultimately help in restoring compassion, mercy, sattva guna, cleanliness (of mind and action) etc. which are essential for development. However if it yields because of foolishness of a few people in the name of democracy it will only turn to "demoncracy". May common sense and prevail amongst everybody. I appreciate the government's decision...Wonderful... better late than never.

Thank you Govt. by Avadhut on 15 Jan 2012

Very delighted to find good intelligence manifest welfare even for the foolish. :) We drink cow's milk, thus we revere the cow at the level of our mother. We are able to consume our biological mother's milk only for few months, but we are blessed to be able to benefit from cow's milk (which is the only source of the human life saving albumin while causing no distress to anyone) for all our life. Cow is unlike any other animal. Even cow's very urine (when distilled) is amazingly beneficial for us human. Just search the internet and see how even the urine and dung of cow is a super life saver. That animal whose even excretions are so life saving for us is especially very respectable. No, I refuse to kill my mother simply in order to satisfy my tongue. Dear agitated one, pls do a favor. Before you now begin ranting your ignorant "arguments" about the topic of cow's milk, Pls do get educated about the topic at hand before you begin demonstrating utter ignorance by what you are saying.

comment by xyz on 13 Jan 2012

I am a minority community doctor working in a backward area of MP. I feel this law is a slur on democracy and it definitely does not take us forward. Freedom of speech, freedom of religion is what the nation propagates and now there is a curb on freedom to eat....Does MP not require our presence? our sacrificial work? Food for thought. This law should be revoked and soon.

Doctor is a Doctor... by Dr Vrinda Baxi on 19 Jan 2012

Dear "Minority Community Doctor" before i proceed to reply, let me humbly say that doctor is a very noble profession and one is simply a "doctor" and not "a minority community doctor". God is one for everybody regardless of their religions, there is only one sun shining for everybody, one wind blowing for everybody, one earth giving food to everybody...The differences have been created cosmetically. But you will also agree different foods and eating habits result in different effects in our body. Taking beef may not immediately kill anybody but it is certainly against the principle of compassion and love to kill an entity who nourishes the whole world on her milk even after our own mother weans us away. It is a simple matter of gratitude. Besides it is spiritually suicidal. This aspect may be little difficult to comprehend, especially when we live in a world which has totally "utilitarian" outlook. An object loses its value the moment it turns useless, no wonder dump their parents in old age home when they are no longer productive and of use. So, a good human being does certain things when it apparently appears useless to others. He will not dump his parents when they are old. Further, a spiritually evolved person has a faculty to discriminate between right and wrong. There are so many women around, a mother or sister is also a woman but a civilized man does not marry his own mother, there are 8 directions but certain directions are auspicious (even in your religion), there are many places but a few are sacred, there are many rivers but a few are sacred rivers like Ganga, there are many plants but Tulasi is worshipable, there are so many human beings but a few are CEOs, doctors etc, similarly there are many animals but cow is spiritually unique and holy. Further, still if one is still not able to control the tongue and want to eat, Please eat...but at least wait for the animal to die its natural death; why do you want to kill and eat? When you say "Does MP not require our presence? our sacrificial work?": Please let me say that they should not see this for anybody, neither for you or anybody else. They should take into consideration only the "righteousness of the issue" and not who is raising it. Regards.

cow slaughter by seshu on 15 Jan 2012

Dear sir, I sincerely appreciate your work as a doctor. As a doctor you should clearly know that eating beef is in no way benificial to anyones health. Cow is a sacred animal. according to vedas a person have 7 mothers. 1) biological mother 2) nurse 3) cow 4) earth 5) wife of a spiritual teacher 6) wife of a king and 7) wife of a brahmana. Cow is a mother to everyone because we drink its milk. We are all children of god. There are some apparent distinctions between hinduism and islam or anyother religion but the core philosophy is to love god. In the same way we as children of same god are brothers and sisters. Everything in the world has got its boundaries. Freedom of speech does not give anyone the right to abuse others and in the same way freedom of religion does not give anyone the right to blaspheme other peoples faith. Hope to take it in good sense.

communal harmony by Mohan on 06 Jan 2012

I adore chicken. I respect them. So all of you please stop eating chicken to promote communal harmony.

mothers by belsha on 16 Jan 2012

I personnally adore lentils, rice and potatoes. They are my mothers. So please stop eating them !

Religion is not what I or You think... by Dr Vrinda Baxi on 19 Jan 2012

Dear Mohan and Belsha... Religion is not something that you and I can sit and concoct, it should always be backed by the words in scriptures. You can call chicken or lentils/ rice/ potatoes as your mother simply because of you want to. I know it is your ignorance, but it cannot be any excuse for making such sarcastic remarks. This space should be respected and I would prefer if some sensible discussion takes place.

Beef by Dr. Cow on 05 Jan 2012

The government has no right to control what we eat, this is totally unfair and unjust.

Think practical by Aslam on 05 Jan 2012

We have lost our common sense long back If the entire nation stops eating meat for just one entire week the whole of cattle grazing population will be at their feet begging to null this act. 1. We do not(and practically never) have enough vegetation growth to feed 1 billion population and growing. 2. Food inflation was a major issue last year and this act does not help there 3. Will be a huge task to feed all that growing cattle

Well Said by Amirtharaj on 06 Jan 2012

Well said :)

Cow Slaughter Law by Sunil on 07 Jan 2012

There is no link between the law and what you are saying. Let us stop saying things just for the sake of saying it.

Solution to polution, malnutrition and hunger by cow lover on 05 Jan 2012

The MP government should make beef as the state dish. This will solve the severe malnutrition and hunger problems in the state which is like sub saharan africa or worse. This will also solve the methane emissions in this highly polluted state.

Cow Slaughter Law by Sunil on 07 Jan 2012

Would you be brave enough to recommend a similar thing to the Saudis - Make Pork as the national dish ? Let us learn to respect the culture and sentiments of the country. There was no cow slaughter for many many centuries before the Mughal invaders came to India. It is something introduced by a foreign culture, not Indian.

why saudis? by black.panther on 10 Jan 2012

Thats a lame argument.Even if pork were to be made a state dish, there would be no one to consume it. In india the people who want to consume it far outnumber those who dont want to.all the muslims, christians, dalits and tribals love beef.

nonsense by black.panther on 10 Jan 2012

Stop telling shit. Its ignorants like you who create problems in our societies.Even manusmriti tells of cow eating.so called lower castes have been eating cows since the time they have been. In the Mahabharata there is a mention of a king named Rantideva who achieved great fame by distributing foodgrains and beef to Brahmins. Taittiriya Brahman categorically tells us: `Verily the cow is food' (atho annam via gauh.).In therapeutic section of Charak Samhita (pages 86-87) the flesh of cow is prescribed as a medicine for various diseases. So stop shitting from your mouth and get some life.

stupid law by abc on 05 Jan 2012

This is a fascist law. This should be repealed. Govt has no right to decide what people can eat. This is a classic case of the oppression of minority by the majority.

Cow Slaughter Law by Sunil on 07 Jan 2012

The minority that we are talking about was not even there in India about 800 years ago. Cow slaughter is something that India did not know before the Mughal invaders came. Let the minority also learn to respect the culture of the majority. I have a lot of friends in the minority, who do not eat meat (not just beef) more than once a week. So why make so much noise about it.

welcome by lokeajit on 04 Jan 2012

this is a welcome step.. cow slaughter should be banned nationally with stringent punishment for those who kill cows. if everyone has right to eat whatever they want then surely cows have their completely right to live and it is these laws which are universally applicable. for those who feel uncomfortable can jump into arabian sea and be served as delicacy to the marine animals.

What will happen to human's by amirtharaj on 06 Jan 2012

Dear Welcome .... you comment on the cow slaughter is half baked .... have you thought what will happen to human's food security if its banned all over ?? do we have enough vegtation to support ?? we also need feed for the cattle .... have you ever thought about all those factors ?? will our country be able to produce so much of vegetation which can support human and also cattle ?? if so the number of cattle will outnumber the humans soon ....

Stupidity by rishi on 06 Jan 2012

Beef is considered to be a global food, banning such on religious grounds is stupid .A large part of the country have beef as thei staple dish and this law wlll bring hard ships to them

This is Insane by zamrul on 04 Jan 2012

How about killing plants for food. They too have lives, don't they feel the pain when we cut them.

Killing plants? by Hemant on 04 Jan 2012

Zamrul, try if you can understand this. Human beings having the ability to make conscious decissions should try to minimize the pain we cause to other living beings. Many other people just like you may argue killing plants is equal to killing animals! But thats stupid! Everyone knows plants have low level of consciousness compared to animals. Its inevitable to eat plants but not animals. If you eat meat, you are not as much human as I am! Eating meat is one of the worst sins even in the openion of great people like Mahatma Gandhi!

Stop killing rats by Dinkan on 04 Jan 2012

I worship rats. The government should also ban killing rats.

cow by pp on 04 Jan 2012

g8..so raise a petition

Government = people by Hemant on 04 Jan 2012

Dinkan! You question the Governments right to ban cow slaughter? Ever thought once about animal rights in your life? What the Government did may not be welcomed by you beef eaters but will you care if the cow wants to get slaughtered before you decide to do that?! In the same way we Hindus and vegetarians DON'T CARE what the beef eaters have to say about this.

Humans first by Amirtharaj on 06 Jan 2012

Dear hemant ... lets care about humans first.... then lets go to animals .... have you thought about the food security of humans ?? is there enough production of veggies to feed humans and also for animals ? the eco cycle will get imbalanced ..... there numbers of the cattle will surely increase and will outnumber humans soon .... so are you going to sterlize those animals at that point or again going to argue that humans have no right to stop those animals from mating ?? if you people are so cared about animals why do you steal the animals milk ??

The Right Conclusion by Soubir on 04 Jan 2012

Just remembered that the Reddy brothers in Karnataka called Sushma Swaraj their mother. By this argument, it alsomakes her a cow. Jai Sri Ram.

cow protection by pankaj on 04 Jan 2012

You and i are inperfect Sir. SO , wat u say and wat I say can be wrong. But when the most perfect person, Krishna says we believe. Therefore cow is our mother, Sir. Just as when we want to learn maths we don't go to anyone but to someone who knows maths. Rt??sir.. So, is the case here. If u kill, u can't expect peace in the society. By he way that was a good humourous comment. Bye

beef national food of kerala by praveen on 03 Jan 2012

lets all go to Kerala and enjoy delicious beef. Beef Ulathiyadu, Beef Fry, Beef Roast, Beef porichadu...frankly, i tell you nothing is more tastier than beef. revoke the law that screw up the common man. down will MP govt. Down with RSS

MP Govt's ban on cow slaugher respects Constitution by Indian on 03 Jan 2012

The Directive Principles of State Policy enshrined in the Indian Constituion made it clear that the cow slwaugher should be banned, similar to Common Civil Code being made applicable to whole of India. The Congress Govt has least regard to the Constitution of India and has always avoiding implementation of ban on cow slaughter similar to avoiding Common Civil Code. It's good to note that MP Govt has taken this courageous step and implemented the wishes of the people who fought for the freedom of the country. Vote bank politics must end somewhere. And, by the way, people who are aggrived should scientifically prove the harm cuased by not eating cow meat.

mr by raj on 03 Jan 2012

This is the true character of bjp and hindutva followers. They want to force people to follow their religious tenets. Now the government will determine what we eat, what religion we follow!. What happened to individual rights?. Bjp gujrat punishes converting to another religion without the collectors permission. Religion is a very personal thing. The government has no right in leaning towards one religion. The center and courts should have stopped these regressive laws. This is typical of discriminative fascist ideologies like hindutva.

cow protection by pankaj on 04 Jan 2012

No raj. Religion means laws of God. Just as there ar eGovt laws which if u break, you hv to undergo punishment. Similarly, if u disobey God's law, suffering will definitely come upon. Fire burns is a law. Doesn't matter u believe it or not. SO u belive or not breaking laws of God by killing an animal for our own selfish enjoyment is a sin. Be careful. Good bye

call the british back by salim on 03 Jan 2012

hate this instead of enforcing anti corruption laws the gov focus on this ????. I hope the british invade india again at least we can eat the food that we used to in their time. Guess india is not a secular nation anymore. Only the corrupt can survive .Migrate when you can kids a dictator is not far away

Thanks for your concern by Hemant on 04 Jan 2012

Salim, Thanks for your concern about fighting corruption! But you know, this is India, a Hindu majority country, The people of the country wanted the law. They had it. You can speak against it as long as you can justify animal slaughter and cruelty to animals.

Well Said by zamrul on 04 Jan 2012

well said. Salim.

Stop killing cow by rahim on 04 Jan 2012

killing cow means killing human race. stop kiling cow. We can not eat our child and parents.. why we eat beef

Make Another Law by Fantom on 03 Jan 2012

If respect comes from making laws, then there should also be law that would punish those people who abandon their cows after they grow older and no longer produce milk. After all she is like our mother. These methods don't buy votes. Apart from Muslims, think of the Tribals and minorities of MP and other states of India who consume beef as a cheap source of animal protein.

Good Job Done by Narayan on 03 Jan 2012

Cow is considered as God in our country where majority of the population is Hindu. Why cannot all minorities come together and support this to show their respect towards Hinduism. There will be a great sense of respect among majority and the minorities.

Lets grow up plz by Manoj on 03 Jan 2012

Are we Hindus supporting the beliefs and religious practices of minorities??? Just becoz India is a Hindu majority nation doesn't mean the minorities have no choice but to do what we do. They have a life and let politicians not dictate what to do with it. I'm an Hindu by birth and I eat beef and pork. Well from where I see things, instead of killing 1 chicken and feeding 2 people I would rather kill 1 cow and feed 600 people. I would be reducing my sins by 300 times by eating beef. POLITICIANS, LET PEOPLE LIVE THEIR LIVES.

cow killing by psharma on 04 Jan 2012

Dear Manoj.....You are doing wrong...You may kill a cow and serve 600 but if you plough a field you can serve more than that without incuring any sin.......why being so cruel my friend....god has given enough fruits and vegetables..eat them....yoour paving a way for hellish life

How about Vegetarians by zamrul on 04 Jan 2012

Agreed.....Manoj. How about Vegetarians? They too get killed in the name of food. Ban Veg as well.

Govt. does it's bit by Ram on 03 Jan 2012

It is one of most heinous sins that humans can accrue by slaughtering cows and eating the meet. The Madhya Pradesh govt., by passing this bill has prevented many prospective heinous crimes against Gomatha.

cow protection by pankaj on 03 Jan 2012

Thats nice!!!!Cow is our mother should always be protected.Till the time we ar e killing cows, we cannot expect peace in the society. Protect her, take milk, make delcious dishes adn in return she asks nothing expect few grass. She is held sacred by scriptures.Serve her , worship her and experience the change.
